국문 초록

가상화폐, 그 중에서도 비트코인과 같이 블록체인을 통한 분산원장기술을 이용한 암호화폐 산업은 지난 10여 년 동안 놀랍게 성장했다. 이러한 성장의 결과 가상화폐 산업은 초기의 혼란과 진통을 딛고 오늘날에는 주류 산업에 근접하게 되었다고 보아도 과언이 아니다. 그러나 가상화폐는 등장 초기부터 불법적 용도로 사용될 수 있다는 우려의 대상이 되어 왔으며 실제로도 그러한 용도로 사용된 사례가 상당수 확인되고 있다. 그러한 사례의 대표적인 예가 가상화폐를 미국의 경제제재를 회피하기 위한 수단으로 사용하는 경우다. 미국의 경제제재는 그 적용 범위와 영향력이 광범위한 것으로 잘 알려져 있다. 특히 2001년 9.11. 테러 직후 이른바 미국 애국자법의 통과에 따라 도입된 금융제재는 제재 대상자들이 전통적으로 사용해온 자금 세탁 및 제재 회피를 더더욱 어렵게 만들었는데, 그 이후 등장한 ‘비트코인’ 외 여러 암호화폐들이 이러한 제재 회피의 새로운 주요 수단이 된 것이다. 최근 미국 정부는 이러한 움직임에 대응하여 가상화폐와 관련된 경제 제재 정책을 정비하고 강화하고 있다. 특히, 미국 정부는 가상 화폐를 이용하더라도 기존의 경제제재 정책을 우회할 수 없음을 명확히 밝히는 동시에 가상 화폐에 특화된 경제 제재 정책도 새롭게 도입하고 있다. 이 논문은 미국의 경제제재의 넓은 적용범위와 높은 영향력, 그리고 가상화폐 거래에서 중요한 위치를 차지하고 있는 우리나라의 지위 등을 고려해 볼 때 우리가 이러한 미국의 가상화폐에 대한 경제제재 정책을 정확히 파악해야 할 시급한 필요성이 있다는 판단 하에 최근에 도입된 미국의 가상화폐 관련 경제제재 정책 및 정책 적용 사례를 법적인 관점에서 살펴보도록 한다. 특히, 이에 대한 자세한 이해를 위하여 최신 관련 사례에 초점을 맞추어 이를 알아볼 것이다.

영문 초록

Virtual currency industry has been growing fast, especially since the introduction of Bitcoin and blockchain technology in 2008. Thanks to such growth, the virtual currency industry is now becoming one of the major economic industries around the globe. However, there have been concerns that the virtual currencies, and especially the cryptocurrencies can be used for illegal purposes, and such concerns were proven to be true by repeated ransomeware attacks and other incidents. Most notably, there have been many cases where virtual currencies were used for the purpose of evading economic sanctions. Among the various economic sanctions issued by different authorities, the U.S. economic sanctions are known to be the most effective and widely applicable. Especially, its secondary boycott regime, which was introduced under the USA PATRIOT Act after the 9.11 terrorist attack in 2001, made it extremely difficult for those sanctioned jurisdictions and individuals to evade the sanctions with traditional methods. With the development of virtual currencies, however, these actors found their way to go around the sanctions, and therefore the virtual currencies became to be known as the major means for sanctions evasions. Recognizing such problem, the United States government is now developing and strengthening its economic sanctions policies with regard to the virtual currencies through new rules and regulations, updated advisories and guidances. This paper examines these new policies and explains how they will be implemented in practice by looking at the recent sanctions violations cases related to virtual currencies.
