방과후학교 법제화 시도의 주요 특징과 쟁점

국문 초록

이 연구는 방과후학교 법제화 시도에서 드러난 특징과 쟁점을 규명하는 데 목적이 있다. 이를 위하여 방과후학교 정책의 추진 과정을 살펴보고, 국회 또는 정부가 입법을 추진한 여러 법안을 검토하였다. 그간의 수차례의 법제화 시도는 방과후학교 운영의 법적 근거를 마련하는 데 초점을 두었다는 점, 수요자 중심교육, 수익자 부담 원칙 등 방과후학교 운영의 원칙과 원리들을 규정하고자 하였다는 점, 장관과 교육감의 책무를 명시하고 협의체 및 지원센터를 설치하고 운영함으로써 방과후학교 운영의 효율성과 안정성을 담보하고자 하였다는 점, 강사와 운영 지원 인력의 배치, 소요 경비 지원 등 방과후학교 인적, 물적 지원체제를 구축하고자 하였다는 점 등의 특징이 있음을 지적하였다. 방과후학교 법제화 시도에서 첫째, 방과후학교 법제화가 반드시 필요한가, 둘째, 초･중등교육법 일부 개정이냐 독립 법안이냐, 셋째, 방과후학교 법제화냐 방과후 활동 법제화냐, 넷째, 방과후학교는 공교육이냐 사교육이냐, 넷째, 방과후학교는 보편적 복지냐 선별적 복지냐 등의 쟁점들이 잠복되어 있음을 확인하였다.

영문 초록

The purpose of this study is to identify the characteristics and issues that have emerged in the attempt to legislate after-school programs. To accomplish this goal, the process of after-school policy promotion, and various legislation of the National Assembly or the government were reviewed. Several attempts to legislate have focused on establishing legal basis for after-school operation have some features. To prescribe to principles of after-school operation such as consumer-centered education, paying beneficiaries. To specify responsibilities of the Minister of Education and the Superintendent, and establish operating councils and support center. This study has discussed five issues in the attempts to legislate after-school programs. First, is it necessary to enact after-school legislation. Second, whether it is partial amendment of the Elementary and Secondary Education Act, or an independent Special Act. Third, to support after-school or support after-school actibilities. Fourth, after-school is public education or private education. Fifth, after-school is universal welfare or selective welfare.
