프로야구리그에서 선수계약과 선수대리인제도

국문 초록

야구선수가 한국프로야구리그에서 선수로서 활동하기 위해서는 한국야구위원회(KBO)가 정한 표준선수계약서인 ‘통일계약서’에 의하여 선수와 구단이 선수계약을 체결하여야 한다. 그런데 1982년 프로야구리그가 시작된 이래 36년 동안이나 한국야구위원회는 선수와 구단관계자 간의 대면계약 제도만을 인정하고, 대리인을 통한 선수계약의 체결을 허용하지 않았다. 한국프로야구선수협회 등의 지속적인 요구에 따라 한국야구위원회는 비로소 2018년 2월부터 대리인을 통하여도 선수계약을 체결할 수 있도록 KBO 규약을 개정하였다. KBO리그 선수대리인 규정에 따르면, 선수대리인은 반드시 선수협회가 정한 자격심사와 자격시험을 거쳐 선수협회의 공인을 받아야 하고, 공인 선수대리인만이 선수를 대리하여 구단과 선수계약을 체결할 수 있다. 선수대리인은 선수를 위하여 선수계약의 교섭 및 연봉계약 체결 업무, 연봉 조정신청 및 조정 업무의 대리를 할 수 있다. 그러나 통일계약서에 의하여 선수계약을 체결하면 보수와 계약기간을 제외하고는 선수와 구단 사이의 권리와 의무에 관한 사항이 일률적으로 정해지기 때문에, 계약내용에 대한 결정의 자유가 사실상 배제된다. 또한 통일계약서는 한국야구위원회가 일방적으로 정한 것이기 때문에 통일계약서에 의한 계약체결은 구조적으로 선수에게 불리하며, 불공정한 계약조항에 의하여 선수의 권리가 침해될 가능성이 매우 높다. 프로야구리그에서 선수대리인제도의 시행에 따라 선수계약이 합리적으로 체결되고 선수의 권익보호가 향상될 것으로 기대된다. 또한 선수가 대리인을 통하여 연봉협상이나 선수계약을 체결함으로써 선수는 훈련 등 경기력 향상에만 집중할 수 있을 것이다. 그리고 선수에 대한 가치평가가 객관화되면서 선수수급시장이 투명해지고, 트레이드 등 선수 교류가 활성화될 것이다. 그러나 프로야구에서 선수대리인의 업무가 보수와 계약기간에 관하여만 구단과 협의할 수 있고 그 밖의 계약내용에 대하여는 통일계약서에 포함된 조항에 따라 일률적으로 정해지기 때문에 그 기대효과는 제한적이라고 할 수밖에 없다.

영문 초록

In order for a baseball player to act as a player in the Korean Professional Baseball League, the player and the club must conclude a player contract under the unification contract , a standard player contract determined by the Korea Baseball Organization (KBO). However, since the 1982 Professional Baseball League started, the KBO has only recognized face-to-face contracts between athletes and team officials and has not allowed players to sign contracts through their agents. In accordance with the continuing demands of the Korea Professional Baseball Players Association (KPBA), the KBO has revised KBO Rules to allow players to conclude contracts through their agents from February 2018. According to the “KBO League Player Agent Rules”, a player agent must be certified through qualifications and examination as prescribed by the KPBA, and only an authorized player agent can conclude a contract with the club on behalf of the player. Player agents can negotiate contracts and salaries, apply for a salary adjustment and represent the adjustment for players. However, if a player contract is concluded under a unification contract, the freedom to decide the contents of the contract is virtually excluded because the matters concerning the rights and obligations between the player and the club are uniformly determined excepting the remuneration and contract period. Also, since the unification contract is unilaterally decided by KBO, the contract under unification is structurally disadvantageous to the player, and the rights of the player are easily infringed upon by unfair contract provisions. It is expected that the player contracts will be reasonably concluded and the protection of player rights will be improved as the player agent system is implemented in the Professional Baseball League. Because the player may conclude an annual salary negotiation or a player contract through an agent, the player will be able to concentrate on improving the performances, such as training. Also, as the valuation of the players becomes more objective, the players supply and demand market will become transparent and exchanges of the players will be more active. In professional baseball, however, the agents can consult with the club only with respect to the maintenance and contract period, and the other contracts are set according to the provisions included in the unified contract, so the expected effect is limited.
