사회복지시설 인권책무에 대한 탐색적 연구

국문 초록

본 연구는 인권책무자로서 사회복지시설의 역할을 탐색적으로 알아보고자 실시되었다. 이를 위해 사회복지시설의 인권책무를 국제인권기준에 근거하여 존중 보호 실현의 책무를 바탕으로 국내 법규를 검토하였으며 심층면접을 실시하여 사회복지시설의 인권책무 경험을 내부자적 관점에서 분석하였다. 연구결과 존중책무는 이용자 중심으로 법에 규정되고 평가에 반영되고 있어 비교적 잘 수행 중이었으나 사회복지시설 운영에 종사자 및 이해관계자의 참여는 부족하였다. 보호책무는 시설의 공식적인 구제제도가 작동하지 않았고 내·외부의 부당한 압력과 폭력으로부터 이용자와 종사자를 보호하는 규정들은 부족했다. 실현책무는 인권교육은 이루어지고 있으나 지역주민 인권증진을 위한 활동과 정책 제안 활동은 이루어지지 않고 있었다. 이러한 연구결과를 토대로 사회복지시설의 인권책무 수행을 지원하는 방안을 정책적으로 제시하였다.

영문 초록

This study aimed to identify the role of social welfare organizations with human rights obligations. First, we reviewed the legal human rights obligations applied to social welfare organizations to examine if they met the international human rights guidelines focusing on respect, protection, and fulfillment. Then, qualitative in-depth interviews were performed to examine individual human rights obligations experienced from an insider s perspective. The results showed that the respect obligation was relatively well performed, which was adequately regulated by law and reflected in the evaluation. However, a lack of participation in the management of organizations by staff members and stakeholders was found. In terms of the protection obligations, the official remedial system at the organizational level was not well implemented. There were insufficient legal documents outlining how to protect the service users and staff members who might be vulnerable to the external environment’s unfair pressure and violence. Finally, although human rights education was fulfilling its obligation, activities for promoting human rights for community members and developing policy proposals were not well performed. This study suggests the need for political actions to strengthen the human rights obligations of social welfare organizations.
