군(軍) 영창제도의 문제점 및 폐지 과정에서 효과적인 제재방법에 대한 고찰

국문 초록

2007년 제정된 징계 양정기준 및 규정에는 징계입창자에 대한 처우 기준 및 절차를 규정 하고 있다. 또한 2011년부터 영창집행 과정에서 부터 적법성을 보장하고, 징계입창자에 대한 인권 보장을 위한 훈령을 제정하여 시행하였다. 수많은 개선과 노력에도 불구하고 영창처분의 문제점은 지속적으로 제기되고 있음에도 불구하고, 근본적인 영창폐지나 이에따른 구체적인 방법이나 제도적 장치는 변화가 없는게 현실이었다. 많은 문제점들 중에 핵심이 되는 사안은 법관이 영장 없이 구금처우시 영장주의 위배, 병사들이 영창에 입창한 기간은 군 복무기간에 산입되지 않아 이중처벌을 받고 있었다. 즉 금지원칙 위배이며, 영창 설치가 법률에 근거를 두고 있지 않다는 점에서 법률유보 원칙 위배, 징계입창자를 미결수용자와 기결수와 동일한 공간내에 구금하고 있어 상대적 열악한 처우를 받고 영창시설에서 생활 하였다. 이러한 부당함을 바로잡기 위해 국회, 학회, 인권단체 등에서 다양한 활동을 펼친 결과 2020년 2월 병에 대한 징계 종류를 규정하여 ‘영창’ 제도 폐지가 124년만에 사라지게 되고 이를 대처할 수 있는 방법으로 ‘군기교육’, ‘감봉’, ‘견책’, ‘휴가단축’ 등 새로운 징계종류가 추가 되어 각급 부대에서 이를 적용하고 있다. 따라서 본 연구에서는 지금까지의 영창제도의 문제점이 무엇이었고, 이에 대한 검토 및 향후 적용 간 각종 교육제도 및 군기강확립에 필요한 효과적인 방법을 제언 하였다.

영문 초록

The disciplinary guidelines and regulations enacted in 2007 stipulate the standards and procedures for the treatment of disciplinary candidates. In addition, since 2011, legality has been guaranteed from the process of execution of the brigade, and a directive has been enacted and implemented to guarantee human rights for disciplinary persons. Despite numerous improvements and efforts, the problem of disposition of brigade was continuously raised, but the reality was that there was no change in the fundamental abolition of brigade, specific methods or institutional arrangements. Among the many problems, the central issue was that a judge violated the warrant principle when detained without a warrant. In other words, it violates the principle of prohibition, violates the principle of retention of the law, because the establishment of the brigade is not based on the law, and the inmates of disciplinary action are detained in the same space as the unconvicted prisoners and the number of convicted prisoners. As a result of various activities in the National Assembly, academic societies, and human rights organizations to correct this injustice, the abolition of the ‘Guardhouse’ system disappeared after 124 years by stipulating the types of disciplinary action against illnesses in February 2020. ‘reductions’, ‘reprimands’, and ‘reduction of vacations’ have been added and are being applied by units at each level. Therefore, in this study, what were the problems of the Guardhouse system so far, and suggested effective methods necessary for establishing various educational systems and military disciplines between review and future application.
