국문 초록

본 연구는 베트남 결혼이주여성의 결혼 및 이혼 과정의 사회문화적 맥락을 파악하고, 이 과정에서 수혜할 수 있는 사회복지 제도 및 서비스와 문제점 등을 탐색하여 개선안을 제시하고자 한다. 먼저, 문헌고찰을 통해 베트남 이주여성의 결혼 및 이혼 관련 현황을 파악하고, 이들의 결혼 및 이혼 선택에 기인하는 사회적 맥락을 정리하였다. 베트남 여성이 한국으로의 결혼 이주를 선택하는 원인과 이혼 선택의 이유들은 긴밀하게 연결되어 있었으며 주로 사회문화적 요인에서 기인하는 것으로 나타났다. 이를 토대로 사례연구 방법을 통해 베트남 한부모 이주여성 관련 비자 제도 및 사회복지 제도와 서비스의 수혜요건을 파악하였다. 결혼 후 영주권이나 국적을 취득하게 되면 다문화 가족을 위한 사회복지 제도 및 서비스를 받을 수 있었으나, 이혼 후 체류 비자를 받지 못할 경우 출국해야 하는 문제점이 드러났다. 마지막으로 현장 전문가와의 인터뷰를 통해 베트남 이주여성이 겪는 어려움을 확인하였다. 이들은 이혼여성으로 본인과 자녀의 신분의 불안정을 경험하였으며, 미비한 법과 제도가 이들의 어려움을 가중시켰다. 이와같은 연구 결과를 토대로 법적, 제도적, 실천적 차원의 제언을 도출하였다.

영문 초록

The study aims to identify the socio-cultural context of the marriage and divorce process of Vietnamese marriage migrant women and to explore the social welfare system and services that they can receive in the process in order to suggest the way to improve the services. First, the current status of marriage and divorce of Vietnamese migrant women was identified and the social contexts affecting their determinations of marriage and divorce were analysed in this study. The analysis found that the causes of their marriage migrant and divorce are closely linked. Using case study method, the eligibility of visa system and social welfare and services were explored. The results showed that Vietnamese single-parent migrant women and their children born in wedlock can be eligible for certain social welfare services as long as obtaining permanent residency or nationality. In a reverse way, they have to leave Korea if they could not obtain a proper visa after divorce. Finally, through the interview with a field expert, the difficulties that Vietnamese migrant women face when they divorced are examined. They experience instability in visa status of their own and their children and the loophole of the related law and system aggravates their difficulties. Based on these findings, legal, institutional, and practical suggestions were made.
