국문 초록

본 연구는 장애인차별금지법에서 규정하고 있는 접근권과 이동권 및 권리구제 제도의 실효성 문제를 검토하고, 장애 차별 문제를 개선하기 위한 제도적 개선 방안을 고찰하였다. 이를 위하여 접근권과 이동권에 대한 실제적인 효력의 문제와 법제간의 관계 및 권리 구제의 문제 등을 살펴보았다. 본 연구에서는 접근권과 이동권의 개선을 위하여 정부의 예산 편성, 교통시설과 운송수단의 장애물을 제거, 부담보충 제도, 다른 법률 개정을 제시하였으며, 권리구제 개선을 위하여 대통령 직속 차별시정위원회 설치, 수임관청제도 운영, 차별판단지침 제정 등의 개선방안을 제시하였다.

영문 초록

The study reviewed the effectiveness on the access right, right of mobility, and remedy for violation of private right defined in the Disability Discrimination Act and investigated institutional improvement direction to improve the disability discrimination problem. For this, actual effectiveness of the access right and movement rights, relations between the legislative systems, problems of remedy for violation of private right, etc were investigated. In order to improve the access right and movement right, the study suggested a government’s budget and to remove obstacles of traffic facilities and transport and modify the bearing supplementary scheme and other laws, and in order to improve the right relief, suggested improvement plans such as installation of the Discrimination Remedy Committee directly responsible to the President, operation of responsible government offices, guidelines of discrimination judgment, and so on.
