건전한 지방재정 육성을 위한 법적 해결방안

국문 초록

저출산고령화, 인구의 수도권 및 대도시로의 이동, 일자리부족 등으로 지방인구감소와 더불어 지역소멸 우려 문제가 야기되고 있다. 또한 지방자치단체의 재정자립도와 지방자치단체의 사회간접자본은 낮아지는데 반하여 사회복지비용의 지출이 지속적으로 증가하고 있는 실정이다. 헌법상 자치권이 보장된 지방자치단체는 지속가능하게 해당 지역주민의 복리사무를 수행하고 주민의 행정수요에 대응하기 위해 자주재원을 확보하여야 하고, 지방재정의 안전성과 효율성확보, 재정운영의 자율성과 책임성이 담보되어야 한다. 지방자치단체의 재정건전성이 확보되지 아니한 경우에는 재정규모팽창, 채무증가, 인플레이션 유발, 지방재정파탄 등 다양한 법적 문제가 발생한다. 특히, 최근 우리나라의 경제의 저성장, 부동산경기의 침체, 인플레이션 심화, 고금리 경향 등으로 재산세와 취득세 편중된 지방세의 구조적 모순으로 인한 지방세수의 감소, 지방채 발행에 따른 채무의 증가, 투자사업의 수익 저하, 재무구조 악화에 의해 지방재정의 건전성확보가 긴요하며, 지방재정의 효율성을 강화하도록 하는 지방재정의 운영발전방향을 강구할 필요가 있다. 이하에서는 지방자치법, 지방재정법상 재정건전성확보를 위한 운영체계를 논의한 후, 건전한 지방재정육성을 위한 세출 관리의 합리화, 지방재정건전화법 제정, 지방재정건전화조례 활성화, 지방재정의 지속가능성 확보, 외부감사제도 강화 등에 관한 법적문제를 검토하여 건전한 지방재정 육성방안을 제시한다.

영문 초록

The aging of low birth rates, the movement of the population to the metropolitan area and large cities, and the lack of jobs are causing problems along with the reduction of the local population. Local governments' financial independence and social overhead capital are decreasing, while social welfare expenses are continuously increasing. Local governments with guaranteed autonomy under the constitution shall secure independent resources to sustainably carry out the welfare of local residents and respond to the administrative demands of residents, secure the safety and efficiency of local finances, and ensure autonomy and accountability in financial management. If the fiscal soundness of local governments is not secured, various legal problems arise, such as fiscal expansion, debt growth, inflation, and local financial collapse. In particular, due to the structural contradiction of local taxes concentrated on property tax and acquisition tax due to the recent low economic growth of our country, the slump in the real estate market, the deepening of inflation, and the trend of high interest rates, it is urgent to secure the soundness of local finances due to the decrease in local tax revenues, increase in debt due to the issuance of local bonds, decrease in profits from investment projects, and deterioration of financial structure. It is necessary to devise a direction for the operation and development of local finances that enhances the efficiency of local finances. After discussing the operating system for securing fiscal soundness under the Local Autonomy Act and the Local Finance Act, we present a healthy local financial promotion plan by reviewing legal issues such as rationalization of expenditure management for sound local financial promotion, enactment of the Local Financial Integration Act, revitalization of local financial consolidation ordinances, securing sustainability of local finances, and strengthening external audit systems.
