국문 초록

As the era of algorithms is coming, and the development of AI technologies. The government has widely used automated administration to improve administration efficiency and promote the construction of digital government. But the drawback of algorithms on black box result in the defective use of due process principle and administrative openness principle, which violates the basic rights of administrative counterparts. In order to solve the problems that arise from the development of new technologies, it is necessary to clarify the meaning and value of due process principle under the era of algorithms, making sure the automated administration complies with the rule of law. Firstly, the rights of algorithm explanation should be built. Secondly, clarify the before-selection mode of automated administration, ensuring the justice of algorithms and building impeccable personal information processing mode. Lastly, refine the accountability system of automated administration and define the obligation between the government and the algorithms design corporations, providing efficient remedy ways for violated rights.

영문 초록

随着算法时代的到来与人工智能技术的发展，行政机关已广泛应用自动化行政以提高行政效率，推动数字化政府的建设。但算法的黑箱特点导致正当程序原则与行政公开原则无法得到良好落实，从而侵犯行政相对人的合法权利。为应对科技发展带来的新问题，应当进一步厘清正当程序原则在算法时代下的新内涵与价值，确保自动化行政不偏离法治轨道。首先，应当依法建立公民的算法解释权。其次，明确自动化行政的事前筛选机制，保障算法本身的公正与建立完善的个人信息处理机制。最后，细化自动化行政的问责机制，明确行政机关与算法设计企业之间的责任，为受损的权利提供有效的救济途径。
