국문 초록

The promulgation of Patriotic Education Law is of great significance to improve China's legal system and improve the quality of patriotic education. The constitutional norms provide the constitutional and legitimate basis for the legislation on patriotism education. Examining the Patriotism Education Law from a constitutional perspective aims to form a coordinated implementation system of constitutional norms and patriotism education legislation. By analyzing the normative structure of the Patriotism Education Law, one can understand the inner logic and scope of patriotism education norms, and at the same time, identify problems and shortcomings in the norms and promote the implementation of the Patriotism Education Law. The follow-up implementation of the Patriotic Education Law should focus on building a three-dimensional patriotic education system with the participation of “the state, society and individuals” and the joint guarantee of “law and culture”, so as to strengthen the effectiveness of the legislation of patriotic education.

영문 초록

爱国主义教育法的出台对完善我国法律体系和提高爱国主义教育质量具有重要意义。宪法规范为爱国主义教育立法提供了合宪性与正当性基础。从宪法角度对爱国主义教育法进行考察，其目的在于形成宪法规范与爱国主义教育立法的协调实施体系。通过对爱国主义教育法进行规范结构的分析，可以理解爱国主义教育规范的内在逻辑和适用范围，同时能够发现规范存在的问题和不足，促进爱国主义教育法的实施。爱国主义教育法的后续实施应着重打造“国家、社会与个人”多元主体参与、“法律与文化”共同提供保障的立体化爱国主义教育体系，以加强爱国主义教育立法的实效性。
