부동산 법정지상권의 주요쟁점에 관한 고찰

국문 초록

본 연구는 법정지상권과 관습법상 법정지상권이 도입되어 지나치게 토지소유권을 제한하는 등의 문제점이 나타나는 점에 착안하여 2018년 1월부터 2022년 12월까지 수원 지방법원 성남지원에서 집행된 매각 물 3,761건과 관련된 법정지상권에 대한 사례연구와 문헌 고찰을 통해 주요 쟁점 사항을 살펴보고, 법정지상권의 개선방안에 관하여 연구하였다. 사례 분석 결과, 법정지상권은 대지, 농지, 임야 등에서 주로 발생하며 아파트 등 신축건물에서 발생하지 않으며, 미등기건물이나 무허가건물, 노후화된 주택 등에서 대부분 발생하고 있는데, 신축건물과 노후화 건물을 같이 취급하여 현실과 많은 괴리가 있는 것을 확인할 수 있었다. 이러한 문제를 해결하기 위하여 첫째, 법정지상권을 건물의 가치를 고려하여 건물의 잔존기간을 산정하여 매각조건으로 정할 필요가 있으며, 둘째, 무허가건물에 대한 관습법상 법정지상권 제도를 적용할 필요가 없으며, 셋째, 관습법상 법정지상권을 지나치게 확대할 필요가 없으며, 넷째, 일괄경매 청구권을 완화해서 건물의 철거도 방지하고 원활한 경매가 이루어질 수 있도록 하여야 하며, 마지막으로 법정지상권 등기 명령 제도를 도입하여 법정지상권의 공시기능을 강화할 필요가 있다.

영문 초록

This study was initiated in consideration of issues such as the introduction of statutory superficies and legal superficies under customary law excessively restricting land ownership. Major issues were examined through case studies and literature reveiws on statutory superficies related to 3,761 properties auctioned by the Suwon District Court Seongnam Branch from January 2018 to December 2022, and measures to improve statutory superficies were studied. As a result of the analysis, statutory superficies mainly occur on land, farmland, and forests and do not occur in new buildings such as apartments but most occur in unregistered buildings, unauthorized constructions, and aging houses. To address these issues, first, it is necessary to calculate the remaining period of a building considering its value and determine it as a condition for auction. Second, the application of legal superficies under customary law to unauthorized constructions is unnecessary. Third, there is no need to excessively expand legal superficies under customary law. Fourth, it is necessary to ease the right to claim collective auctions to prevent the demolition of buidlings and facilitate auctions. Lastly, the introduction of a statutory superficies registration order system is needed to enhance the disclosure function of statutory superficies.
