입찰제도의 안전역량평가 개선방안에 관한 연구

국문 초록

국내 산업재해에 의한 사고사망만인율은 0.43‱로 OECD 평균인 0.29‱과 비교했을 때 상당히 높은 수준이다. 특히 전체 사고사망재해의 약 46%가 건설업에서 발생(2022년 기준) 하고 있다. 정부를 포함한 사회 각계의 건설재해 감소 노력에도 불구하고, 건설업의 안전사고가 감소하지 않는 가장 큰 이유는 입찰단계의 취약성 때문이다. 공공공사 발주시 입찰자를 대상으로 안전역량을 평가하여 일정 수준 이상의 건설사만을 낙찰자로 결정해야 하지만, 제도적 한계에 따라 안전역량이 부족한 건설사도 낙찰자로 결정되는 문제가 가장 크다. 따라서 본 논문은 입찰단계에서 안전역량평가를 실시하여 자격을 갖춘 적격 수급업체만이 계약을 체결할 수 있는 제도적 개선 방안을 연구하였다. ｢산업안전보건법｣의 적격 수급인 선정의무를 계약제도와 연계하여 연구하였고, 외국의 안전선진국 사례를 통해 입찰단계의 안전역량평가 체계와 중요도를 확인하였다. 그 결과를 토대로 계약제도의 개선 방안과 적격 수급인 선정의무의 유도 방안을 제시하였다.

영문 초록

To mitigate industrial accidents, various societal sectors, including the government, have been actively implementing measures. These include revising laws to bolster industrial safety and enhancing related standards. Despite these policy efforts, the rate of industrial accidents has not significantly decreased. A primary reason for the persistence of safety incidents in the construction industry is the selection of contractors with inadequate safety and health standards during the bidding process. This study explores legal improvements enabling local governments and public companies to prioritize bidders with proven safety capabilities. It examines the Occupational Safety and Health Act, the Local Contract Act, and safety assessment systems in other countries to fulfill this objective. Our research indicates the necessity of implementing a safety competency evaluation prior to finalizing the successful bidder. Additionally, it highlights the need for enhancements in the contract-related system to support this initiative.
