탐정업의 구체적 실현 방안에 관한 논의

국문 초록

이 연구는 이미 오래전부터 학계에서 이루어져 온 탐정업의 필요성에 대한 합의를 기초로 그 구체적 실현 방안에 관한 논의를 도출하기 위해 수행되었다. 연구목적 달성을 위해 현재 제21대 국회에 계류 중인 3개 법안에 대한 검토를 실시하고, 우리보다 먼저 탐정업을 법제화 하여 시행해온 일본의 사례를 검토하였고, 이를 통해 다음의 결론을 도출하였다. 첫째 예외적 금지주의의 견지에서 업무범위 규정, 둘째, 행정처분 대상 위반행위의 세분화와 중요성에 따른 경찰청장의 재량권 제한, 셋째, 공인자격제화, 넷째, 위원회 구성에 관한 규정의 위임, 다섯째, 신체·정신장애로 인한 등록 거부 규정의 실효성 확보를 위한 규정 마련, 여섯째, 탐정의 의무위반에 관한 지나친 법제화 지양 등이다. 그러나 여전히 세부적인 측면에서 구체적 방법론을 도출하지는 못하였고, 구체적 대안에 대한 대강의 방향만을 제시할 수 밖에 없다는 점에 연구의 한계가 있다. 다만, 이연구가 추후 법안 작성시에 자료로 활용될 수 있다는 점, 이 연구에서 제시된 몇몇 대안들에 대한 심도 있는 논의의 출발점이 될 수 있다는 점 등은 이 연구의 의의라 하겠다.

영문 초록

This research was conducted to derive discussions on the concrete implementation strategies based on the consensus in the academic community about the necessity of the detective industry, which has been ongoing for a long time. To achieve the research objectives, a review of three bills pending in the current 21st National Assembly was conducted, and the case of Japan, which has implemented detective legislation ahead of us, was examined. Through this, the following conclusions were drawn. Firstly, provisions regarding the scope of business under exceptional prohibitionism; secondly, limitations on the discretion of the police chief according to the granularity and importance of violations subject to administrative disposition; thirdly, delegation of authority on committee composition; fourthly, establishment of provisions to ensure the effectiveness of refusal of registration due to physical or mental disabilities; fifthly, avoidance of excessive legislation on breaches of detective obligations. However, there are limitations to the research as specific methodologies have not been derived at the detailed level, and only rough directions for specific alternatives can be provided. Nevertheless, the significance of this research lies in the fact that it can be utilized as a reference in future bill drafting and can serve as a starting point for in-depth discussions on some of the alternatives proposed in this study.
