연구부정행위 검증에 관한 공법적 검토

국문 초록

연구부정행위는 학문의 자율성과 진실성을 훼손하고 학문 분야에 대한 사회적 신뢰도를 저하시키는 심각한 문제이다. 연구부정행위를 검증하는 방법으로 활용되고 있는 동료심사는 학문의자유를 보장하기 위해 국가의 개입이 최소화되고 이를 통해 학문 분야의 자율적인 상호통제로서구현되었으나 연구부정행위의 특성과 부정적인 영향력을 고려하면 객관성과 공정성이 충분하지않다는 비판을 받고 있다. 본 연구는 위와 같은 관점에서 동료심사의 한계를 인식하고 학문의 자유와 조화를 이루는 동시에 연구부정행위 검증의 객관성과 공정성을 실효적으로 담보할 수 있는 대안으로 ‘법률지식 기반의 연구부정행위 검증 절차 전문가 양성과 활성화’를 제안한다. 법률지식 기반의 연구부정행위검증 절차 전문가는 연구부정행위의 조사 절차와 판단 기준에 대해 법적인 관점에서 판단하고, 절차적 정당성(due process)을 확보하는 임무를 수행할 수 있다. 이를 위해서는 로스쿨 제도 도입 이후 등장한 다양한 학문을 겸비한 법조인, 기존에 활동 중인 특정 학문 분야 연구윤리 전문가등을 대상으로 연구부정행위 검증 절차 보완에 필요한 교육과 훈련을 제공하고, 그들의 신분과권한을 보장할 수 있도록 관련 규정을 정비해야 한다.

영문 초록

Research misconduct is a serious problem that damages the autonomy and truthfulness of academia and lowers the social trust in academic fields. Peer review, which is used as a method to verify research misconduct, has been implemented as a self-regulation of academic fields by minimizing the intervention of the state to ensure academic freedom. However, it has been criticized that peer review is not sufficient in terms of objectivity and fairness, considering the characteristics and negative impacts of research misconduct. This study recognizes the limitations of peer review and proposes ‘the training and activation of research misconduct verification procedures experts based on legal mind’ as an alternative that can effectively guarantee the objectivity and fairness of research misconduct verification while harmonizing with academic freedom. Research misconduct verification procedures experts based on legal mind can evaluate the investigation procedures and judgment criteria of research misconduct from a legal perspective and secure the procedural justice. To this end, interdisciplinary lawyers who have emerged since the introduction of the law school system, as well as existing research ethics experts in specific disciplines, should be provided with the necessary education and training to supplement the research misconduct verification process, and relevant regulations should be revised to ensure their status and authority.
