고등교육 재정교부금법에 관한 재정법적 고찰

국문 초록

‘교육비특별회계’와 ‘지방교육재정교부금’제도를 통해 안정적으로 재정이 확보된 초중등교육과 달리, 고등교육에 대한 재정지원 법제는 재량적·계획적 내용을 주로하는 규정이 존재할 뿐 구체적·기속적 규정은 발견되지 않는다. 윤석열 정부 출범 이후 고등교육 재정지원의 체계와 방식이 교육부와 전문기관 중심에서 RISE 사업의 시행으로 인해 지방자치단체 중심으로 재편되었다. 이와 같은 환경변화로 인해 재정지원에 관한 중요한 사항의 처리와 위원회 등 조직법적 규정 및 분쟁해결 등의 처리를 위한 입법적 조치가 필요하게 되었다. 국가 산업·경제·연구 및 문화 등의 영역에 있어서 경쟁력을 확보하기 위해서는 대학교육 및 연구의 수월성을 확보할 필요가 있으며, 이를 교육수요자의 비용부담을 통해서 주로 충당하는 방식은 자칫 대학 발전의 지장과 함께 국가 경쟁력 저하를 초래할 위험이 있다. 따라서 국가의 엄격한 평가 및 모니터링과 함께 대학에 대한 일반 재원 즉, 재정교부금제도를 도입함으로써 대학의 역량을 획기적으로 개선할 필요가 있다. 고등교육재정교부금 중 보통교부금과 사업성교부금으로 달성하기 곤란한 개별 대학에 대한 재정지원은 포괄보조금의 방식으로 재정지원하여 재정에 있어서 대학 자율성을 견지하는 것이 적절하다고 할 수 있다. 또한 회계처리의 방식으로 현행 시행되고 있으나 한시법인 ｢고등·평생교육지원특별회계법｣의 상시법으로의 전환을 고려할 필요가 있다.

영문 초록

Unlike elementary and secondary education, which is stably funded through the “Special Account for Education Expenses” and “Local Education Finance Grant” systems, the financial support law for higher education only has discretionary and planning regulations, but no specific or binding regulations are found. Since the inauguration of the Yoon Suk Yeoln government, the system and method of financial support for higher education have been reorganized from the Ministry of Education and specialized institutions to local governments due to the implementation of the RISE project. Due to such environmental changes, legislative measures are needed to deal with important matters related to financial support, organizational regulations such as committees, and dispute resolution. In order to secure competitiveness in areas such as national industry, economy, research, and culture, it is necessary to secure excellence in university education and research, and the method of mainly covering this through the cost burden of education consumers risks disrupting university development and lowering national competitiveness. Therefore, it is necessary to dramatically improve the capacity of universities by introducing a general financial resource, or financial grant system for universities, along with strict evaluation and monitoring of the state. Among the higher education financial grants, it is appropriate to maintain university autonomy in finance by providing financial support to individual universities that are difficult to achieve with ordinary grants and business performance grants. In addition, although it is currently implemented as an accounting method, it is necessary to consider the conversion of the temporary corporation “Special Accounting Act for Higher and Lifelong Education Support” to the regular law.
