일본의 싱가포르 조정협약의 실시법의 소개

국문 초록

일본에서는 최근 2023. 4. 21. ‘조정에 의한 국제적 화해합의에 관한 국제연합협약’(United Nations Convention on International Settlement Agreements Resulting from Mediation)의 내용을 준거로 한 국내 실시법인 ‘조정에 의한 국제적인 화해합의에 관한 국제연합조약의 실시에 관한 법률’(Act for Implementation of United Nations Convention on International Settlement Agreements Resulting from Mediation)이 2023. 4. 21. 성립하였다. 이후 2023. 6. 6. ‘민사관계절차 등에 있어서 정보통신기술의 활용 등의 추진을 도모하기 위한 관계 법률의 정비에 관한 법률’에 의해 실시법에 대해서도 재판절차의 IT화에 관한 개정이 행하여졌다. 일본의 위 국내 실시법은 국제조정에서의 화해합의(settlement agreement)에 대해 일본에서의 집행에 관한 틀을 도입하는 것이다. 일본은 조정이 성립한 경우에 집행력을 부여하는 것이 일본 국내법과 충돌이 있을 수 있다는 등의 이유로 처음에 위 싱가포르 조정협약 자체에 대해 서명하지 않았지만, 반면 최근 우리보다 먼저 위와 같이 국내 실시법을 제정하였고, 또한 이 국내 실시법의 성립과 함께 현재 위 싱가포르 조정협약의 체결을 위한 준비를 진행하고 있다. 그리하여 일본의 위 국내 실시법의 성립으로부터 앞으로 우리가 제정할 국내 이행법률에의 시사점을 찾을 수 있다고 보아, 본 글에서는 우선 싱가포르 조정협약에 관하여 약간 언급하고, 위 일본의 실시법 제정의 경위 등을 소개하는 것과 동시에, 그 개요 및 내용을 살펴보고자 한다. 위 실시법은 최근 제정된 법률이므로, 아직 일본 법무성으로부터의 법률 소개 자료 이외에 현재 공간된 문헌이 없다는 점에서 본 글은 본격적 논문으로서는 한계가 있다는 점을 밝히면서, 다만 우리와 유사한 입법 상황에서 위 실시법을 국내에 소개하는 점에서 본 글의 의미를 찾고자 한다. 앞으로 우리도 싱가포르 조정협약의 국내 이행법률을 제정하여야 하는데, 우리는 일본과 달리 아직 민간형 조정에 관하여는 단행 법률이 없으므로 이 점도 고려하여 국제상사조정의 세계적 추세에 대처하여 나가야 할 것이다.

영문 초록

Japan, on April 21, 2023, a domestic implementation law, ‘Act for Implementation of United Nations Convention on International Settlement Agreements Resulting from Mediation’ based on the contents of the United Nations Convention on International Settlement Agreements Resulting from Mediation was recently established. Subsequently, on June 6, 2023, the 'Act on the Reorganization of Related Laws to Promote the Utilization of Information and Communication Technology in Civil Relations Procedures, etc.' was amended regarding the IT implementation of trial procedures as well. The above domestic implementation law in Japan introduces a framework for enforcement in Japan of settlement agreements in international mediation. Japan initially did not sign the Singapore Mediation Convention itself for reasons that the granting of executive power in cases where mediation is established may conflict with Japanese domestic law. On the other hand, with the establishment of this domestic implementation law, preparations are currently underway for the conclusion of the above-mentioned Singapore Coordination Agreement. Therefore, considering that the establishment of the above domestic implementation law in Japan can provide implications for the domestic implementation law to be enacted in the future, this article first briefly mentions the Singapore Mediation Convention, and describes the circumstances of the enactment of the above implementation law in Japan, while reviewing its outline and contents. Since the above implementation law is a recently enacted law, this article has limitations that there is no document currently available other than the law introduction data from the Ministry of Justice of Japan. However, The meaning of this article can be found in that the above implementation law is introduced in Korea in a similar legislative situation. In the future, Korea also has to enact domestic implementation laws of the Singapore Mediation Convention. Unlike Japan, there is no single law on private mediation in Korea yet, so we will have to take this into consideration and cope with the global trend of international commercial mediation.
