성소수자 인권 제도 이후의 제도화 과정 분석

국문 초록

본 연구는 성적지향과 성별정체성을 차별금지사유로 명시하고 있는 서울특별시 학생인권조례 사례를 통해 성소수자 인권 제도 이후의 제도화 과정을 분석하였다. 조례 제정 이후 성소수자 인권 옹호 담론 연합과 반성소수자 담론 연합 간 역동을 통해 나타난 제도화 과정은 1)성소수자 인권 제도에 대한 제도적 저항 및 부인 시기, 2)성소수자 인권 제도의 조용한 시행 시기, 3)성소수자 인권 제도의 명시적 집행 및 위기의 혼재 시기로 구분되었다. 성소수자 인권 단체와 시의회, 교육청, 헌법재판소가 담론 연합을 형성하면서 “성소수자에게 평등하고 안전한 학교” 스토리라인이 학생 인권 정책 추진 과정에 부분적으로 반영되고 공고화되는 담론 제도화 양상을 보였다. 하지만 다른 한편으로 개신교 우파와 보수 시의원, 보수 교육감이 반성소수자 담론 연합을 형성하면서 “동성애 조장” 스토리라인이 학생인권조례반대 담론장에서 고착화되는 양상을 보였다. 이는 성적지향과 성별정체성을 차별금지사유로 명시한 이후에도 성소수자 인권이 “담론 구조화 없는 담론 제도화” 상태에 머물러 있음을 의미한다. 또한 성소수자 인권을 지지하는 공식적 정책행위자 역시 이성애규범성과 성별이분법이 작동하는 다양한 방식을 문제화하지 못하고 “뭉툭한” 대항 담론을 생성하는 한계를 보였다.

영문 초록

Based on the case of the Seoul Student Human Rights Ordinance, this study analyzes the institutionalization process that has happened since the ordinance that stipulates sexual orientation and gender identity as prohibited grounds of discrimination was adopted. After the enactment of the ordinance, the institutionalization process through the dynamics between the pro-LGBTQ discourse coalition and anti-LGBTQ discourse coalition was divided into three periods; 1)institutional resistance to and denial of LGBTQ rights, 2)silent implementation of LGBTQ rights-related policies, 3)coexistence of explicit enforcement of LGBTQ rights-related policies and crisis of these policies. The city council, education office, and the Constitutional Court formed a pro-LGBTQ discourse coalition, which resulted in discourse institutionalization of LGBTQ rights through which the “equal and safe school for LGBTQ people” storyline was partially reflected and solidified. However, on the other hand, the Protestant Right, conservative city councilors, and the conservative education superintendent formed an anti-LGBTQ discourse coalition, and the “promotion of homosexuality” storyline became solidified in the discursive field of the anti-student human rights ordinance. This means that even after the inclusion of sexual orientation and gender identity as prohibited grounds of discrimination, LGBTQ rights have remained a situation of “discourse institutionalization without discourse structuration”. Moreover, the discourse of official policy actors supporting LGBTQ rights has not moved beyond a “blunt” counter-discourse by failing to problematize the multiple ways in which heteronormativity and gender binarism operate.
