국문 초록

우리나라에서 지역의 균형발전이 여전히 중요한 국가목표가 되고 있으며, 헌법개정을 통해 그 발전을 견인해야 할 필요가 있다. 본 연구에서는 지역균형발전 관련 헌법 개정을 위하여 모색하여야 할 그 방향, 체제, 내용에 대하여 논의하였다. 헌법 제 8장 지방자치의 장, 제 9장 경제의 장에서 ‘균형’, ‘지역’ 등이 언급된 헌법조항을 분석정리하고, 현재까지 제시된 주요 헌법개정안들을 분석하였다. 지역균형발전의 논의를 위해 ‘지역’, ‘균형’, ‘발전’의 개념의 성찰이 필요하다. 지역은 지리적인 요소도 중요할 것이나 생활기반적 공간 지역으로서 사람이 소속되고 있는 공간 영역이라는 정신적 요소도 자리잡은 관념이라고 볼 수 있다. 지역균형이란 모든 지역공동체들을 골고루 발전시켜야 함을 의미하면서 각 지역공동체마다 차이, 다양성을 인정하고, 발전에는 경제적 발전뿐만 아니라 문화적인 발전, 정신적인 발전이 포함되어야 한다. 이와 같은 논의를 바탕으로 본 연구에서는 헌법개정의 방향으로 지역 자치와 균형 발전을 동시에 추구한다는 지향점과 아울러, 기초성, 다양성, 균형성, 지속가능성, 미래지향성의 내용적 방향성을 제시하였다. 헌법의 지방자치의 장 이외에도 균형과 관련된 조문들을 재정비할 필요가 있고, 헌법전문, 헌법총강에 원칙규정화의 중요성을 논의하였다. ‘공화주의’에 기초하는 지역공동체를 고려하여 현행 헌법 제1조 제1항을 “대한민국은 지역공동체들로 구성되는 민주공화국이다”라고 개정하는 것을 제안하였다. 현행 헌법 ‘제8장 지방자치’ 장의 개정에서는 ‘지방’이란 용어가 중앙 아래나 변방임을 암묵적으로 제시할 수도 있으므로 ‘지역’으로 변경할 것을 제시하였다. 개정의 내용으로서 (1) 지역공동체 사무 (2) 보충성의 원칙 (3) 자치입법권의 강화 (4) 문화적, 정신적 균형발전의 필요성 (5) 주민자치의 강조 (6) 재정자치조항 (7) 통일시대에 또는 통일을 향한 과정에서의 지역공동체 역할을 개정안에서 강조되어야 하며, 기속위임금지의 헌법원리를 따라 공동체 전체의 이익을 생각하는 것이 필요함을 논의하였다.

영문 초록

Balanced regional development is still an important national goal in Korea, and it is necessary to lead the development through constitutional amendment. In this study, we discussed the direction, system, and contents of regulations related to regional autonomy and balanced regional development, which are necessary for the constitutional amendment related to balanced regional development. Chapter 8 of Local Autonomy and Chapter 9 of the Economy of constitutional provisions were analyzed and constitutional amendment proposals proposed so far were analyzed. In this study, the meaning of ‘region’ is defined not only as a geographical elements but also as a living-based space region, the emotional and intellectual element of a spatial area to which people belong. Regional balance means that all local communities should be equally developed while the differences and diversity of each local community should be acknowledged, and development should include not only economic development but also cultural and spiritual development. Based on these discussions, this study presented the direction of constitutional amendment as pursuing local autonomy and balanced development at the same time, foundation, diversity, balance, sustainability, and future orientation. It is necessary to begin stipulating the importance of regional autonomy in the preamble and general propositions of the Constitution was discussed. Considering the republican-based community, it was proposed to amend Article 1, Paragraph 1 of the current Constitution to “The Republic of Korea is a democratic republic composed of regional communities.” In the discussion of the direction and contents of the revision of the current constitutional chapter ‘Chapter 8 Local Autonomy’, it was proposed to change it to ‘region’ because the term ‘region’ could implicitly suggest that the term ‘local’ is a periphery below the center. (1) Local community affairs (2) Principle of subsidiarity (3) Strengthening of autonomy legislation (ordinances and rules) (4) Necessity for balanced cultural and spiritual development (5) Emphasis on resident autonomy (6) Financial autonomy provisions (7) The role of the local community in the era of unification or in the process toward unification must be emphasized in the amendment, and it is necessary to consider the interests of the community as a whole according to the constitutional principle of prohibition of binding mandate.
