국문 초록

다수의 권리자들이 존재하는 영상저작물의 활용을 안전하게 보장하기 위해 영상저작물에 대한 권리를 영상제작자에게 집중시키는 방식은 영상저작물의 활용을 위한필요조건이다. 그러나 권리양도를 통해 권리가 집중되는 과정에서 권리양도와 저작자와 실연자에게 정당한 보상이 지급되는 것이 균형을 이루어야 한다. 그러나 우리나라의 저작권법에 규정된 영상저작물 특례규정은 저작자와 실연자의 권리양도를 강제하지만 이에 대한 보상은 당사자에게 임의로 맡기는 불균형적인 모습을 가지고 있다. 숏폼 콘텐츠와 같은 2차적 이용 형태가 증가할수록 이러한 불균형의 효과는 확대될수밖에 없다. 따라서 우리나라 저작권법에 규정된 영상저작물 제작에 관한 특례 규정에 권리 양도를 추정 받는 저작자와 실연자에게 권리 상실에 따른 보상청구권을 도입할 필요가 있고 특례 규정의 적용범위를 제한적으로 해석할 필요가 있다. 또한 영상저작물 특례규정과 집중관리단체의 권리충돌에 대해서 우선순위 결정을 위한 규정을도입해야 한다.

영문 초록

A study to protect the rights of performers for short-form contentTo safely guarantee the utilization of audiovisual works in which many actors, writers, and directors participate, it is necessary to concentrate on the rights of audiovisual works for audiovisual works producers. However, in the process of concentrating through the transfer of rights, authors and performers should have a right to fair remuneration for the loss of their rights. Korean copyright law does not grant an obligation to remuneration for the transfer of rights or the permission of use. The regulation of “SPECIAL CASES CONCERNING CINEMATOGRAPHIC WORKS” enforces the transfer of rights of authors and performers, but the remuneration of the transfer remains in the principle of freedom of contract. This relationship seems unequal. As secondary uses of audiovisual works, such as short-form content, increase, this inequality should only increase as well. The provision of “SPECIAL CASES CONCERNING CINEMATOGRAPHIC WORKS” should introduce fair remuneration rights for authors and performers that transfer their rights to audiovisual works producers, and the range of this transfer should be limited in favor of the authors and performers. In addition, regulations should be introduced to determine the priority between the transfer of rights and collective rights management.
