국문 초록

한국의 테러방지법상 테러의 정의조항은 외국의 입법례에 비추어 크게 무리가 없다. 특히 ‘국가․지방자치단체 또는 외국 정부의 권한 행사를 방해하거나 의무 없는 일을 하게 할 목적’이나 ‘공중협박의 목적’을 구성요건으로 제시한 것은 선진국들의 테러 관련 정의규정에 비추어 적절하다고 볼 수 있다. 다만 공중의 개념과 내포가 반드시 확실치 않다. 구체적으로 테러대상 내지 피해규모와 관련해서 숫자상으로 명확히 선을 긋기가 어렵다. 이 점에서 공중이라는 단어 앞에 ‘하나 이상의 사람’이라는 용어를 추가함으로써 특정인이나 소수의 사람을 대상으로 해서도 얼마든지 테러가 행해질 수 있음을 분명히 할 필요가 있다. 더불어 화재․산불 감시 등 공용목적으로 사용되는 초경량비행장치에 대한 공격, 9․11테러와 같이 항공기를 이용한 자살폭탄테러, 최근 국내외적으로 이슈가 되고 있는 새로운 양상의 테러, 곧 드론 등에 의해 다른 항공기나 항공시설 또는 사람의 인명이나 안전, 기타 공공의 재산․시설물에 대한 중대한 손괴를 가하는 테러공격을 충분히 커버하지 못하고 있다. 이러한 문제점을 해소할 수 있도록 테러 정의조항을 정비할 필요가 있다.

영문 초록

The definition of terrorism under the Korean ”Act on Anti-terrorism for the Protection of Citizens and Public Security(generally abbreviated as Anti-Terrorism Act)” enacted in 2016, is not unreasonable in light of foreign legislative examples. In particular, it may be considered appropriate in light of advanced countries' definition of terrorism to formulate ”the purpose of interfering with the exercise of the authority of the state, local governments, or foreign governments” or ”the purpose of public intimidation” as constituent requirements. However, the concept and implication of ”the public” are not necessarily certain. Concretely speaking, it is difficult to draw a clear line numerically regarding the target of terrorism or the scale of damage. In this respect, it is proper to make it clear that terrorism can be committed against a specific person or a small number of people by adding the term ”one or more than one person” before the word ”public”. In addition, it does not cover attacks on ultra-light vehicles used for public purposes, including security surveillance, forest fire monitoring etc, suicide bombings attacks using airplanes such as the September 11 terrorist attacks of 2001, significant damage to human life or public property and facilities by small aircrafts or drone attacks. It is quite necessary to revise the definition of terrorism in order to solve these problems.
