소방시설공사업법 분리발주 전후의 성과 및국외 사례 분석을 통한 제도 개선 방향 검토

국문 초록

국내의 경우 2020년 9월 이후 소방시설공사업법 분리 발주의 의무화가 시행되었다. 현재까지 소방시설공사업의분리발주제도 시행 이후에 효율적인 정착을 위한 반향으로서 성과분석, 국외 제도 검토 등에 관한 연구가 미흡한실정이므로 이에 대한 연구가 필요하다. 본 연구는 최근 4년간의 소방시설공사업 분리발주 전 후의 성과 데이터를 ·수집하여 시각화 하였고, 국내 외의 입법 사례에 대해 분석하였다. 분석 결과, 국내 분리발주 시행 이후 소방시설공 ·사업의 실적의 경우 2020년부터 2021년까지 공사금액 증가율이 44.7%로 나타났다. 국외 분리발주제도의 사례는 공종별 및 공사 금액에 따라 분리발주를 불공정 수주를 막기 위하여 시행되었다. 따라서 본 연구에서는 공사 규모에따른 금액의 적정성과 비율 증대를 위한 법제적 조치를 제안하였다.

영문 초록

In Korea, separate orders for the fire-fighting facility system installation business act have been in effect since September2020. However, the current research on performance analyses and overseas system reviews remains inadequate for efficientsettlements after the implementation of the separate order system for the fire-fighting system installation business act. Inthis study, we collected and visualized performance data before and after the implementation of separate orders for thefire-fighting system installation business act over the past four years and analyzed domestic and foreign legislative cases. As a result of the analysis, for the fire-fighting system installation business act, following the implementation of separateorders in Korea, the growth rate of construction amounts from 2020 to 2021 was found to be 44.7%. Moreover, a caseof overseas separate orders was implemented to prevent the occurrence of unfair orders in separate orders according to thetype and amount of construction. Therefore, in this study, a legal plan to improve the appropriateness and ratio of theamount according to the size of construction is devised.
