특별지방자치단체에 관한 일고찰

국문 초록

지방자치법 전면개정은 제도보장에 불과했던 지방자치제도를 한단계 발전시킬 수 있는 좋은 기회이다. 특히 제12장에 특별지방자치단체에 관한 규정이 신설되고 이에 따라 부울경메가시티 출범이 현실화되면서 이에 대한 논의가 활발하였다. 비록 출범 직전에 좌초되었지만 충청권 등 다른 지역에서 특별지방자치단체의 설립이 계속 추진되기에 이에 대한 논의는 계속되어야 할 것이고, 관련 법제도 계속 개선될 필요가 있다. 이 제도가 실제로 잘 운영될 수만 있다면 수도권 밀집이 큰 문제인 우리의 현실에서 이를 극복하기 위한 좋은 제도가 될 수 있을 것이라 기대되기 때문이다. 지방자치법은 지방자치단체조합보다 발전된 형태의 더 강한 협력체로서의 연합의 형태로 특별지방자치단체를 설정하고 있다. 그 특성을 비교해 볼 때 지방자치단체조합의 경우 각 구성 지방자치단체간의 물리적 결합에 가깝다면, 특별지방자치단체는 구성 지방자치단체간의 화학적 결합에 가까운 것으로 볼 수 있기 때문이다. 다만 특별지방자치단체 관련 지방자치법 규정의 해석과 관련하여 기존의 법리로 해석하기 어려운 부분이 있고, 실제 적용에 있어서 난해한 점이 있기에 이의 개선이 필요하다고 생각된다. 예를 들어 특별지방자치단체 설치와 관련하여 의회의 구성방법, 단체장의 선출방법 등이 헌법상의 지방자치단체의 본질과 다른 부분이 있어 이를 지방자치법상의 지방자치단체의 한 종류라고 할 수 있을지는 모르겠지만, 헌법상 개념으로는 지방자치단체가 되기 어렵기에 의회구성방법 등에 대한 개선이 필요하고, 규약의 법적 성격이 명확하지 않기 때문에 실제 규약이 가지는 규범력을 고려하여 이 부분을 입법적으로 해결할 필요가 있다. 이러한 개선점을 도출하는데 참고하기 위해 독일 슈투트가르트 지역연합의 예를 구체적으로 살펴보고 이를 통해 우리에게 주는 시사점을 분석하였다.

영문 초록

The full revision of the Local Autonomy Act is a good opportunity to develop the local autonomy system, which was only a guarantee of the system. In particular, as the regulations on special local governments were newly established in Chapter 12, and the launch of the Bu-Ul-Gyeong Mega City became a reality, discussions on this were active. Although it ran aground just before its launch, discussions on the establishment of special local governments in other regions, including the Chungcheong region, will continue, and related legislation needs to be improved. The Local Autonomy Act establishes special local governments in the form of associations as stronger cooperatives in an advanced form than local government associations. Comparing its characteristics, if local government associations are close to physical bonds between each constituent local government, special local governments can be seen as close to chemical bonds between constituent local governments. However, in relation to the interpretation of the provisions of the Local Autonomy Act related to special local governments, it is difficult to interpret as the existing legal principles, and there are difficulties in actual application, so it is necessary to improve them. For example, in relation to the establishment of a special local government, the method of composition of the council and the method of electing the head of a local government are different from the nature of the local government under the Constitution. Therefore, this can be said to be a type of local government under the Local Autonomy Act, but it is difficult to become a local government under the constitutional concept. Moreover, the legal nature of the agreement is unclear. Therefore, it is necessary to legislatively solve this part in consideration of the normative power of the actual agreement. In order to refer to these improvements, we examined in detail the examples of the Stuttgart Regional Union in Germany and analyzed the implications for us through them.
