우리 지방자치법상 특별지방자치단체에 대한 소고

국문 초록

지방인구 감소 등에 따른 지방소멸 위기(위험)은 선진국들의 공통적인 문제가 되고 있는바, 우리나라의 경우에는 여기에 심각한 인구불균형분포 문제와도 맞물려 더욱 심각한 상황이다. 이에 따라 국가는 물론이고 지방자치단체도 나름의 해결방안을 강구하는데 몰두해 오고 있는바, 최근 2021년 1월 12일 전부개정 지방자치법에서도 그것을 반영하고 있다. 즉 2021년 전부개정 지방자치법상 주요 개정내용은 지방자치단체 기관 구성 다양화(제4조), 지방자치단체 관할구역 경계변경제도 개선(제6조), 지방자치단체 규칙에 대한 주민의 제·개정, 폐지의견 제출권 인정(제20조), 주민감사청구제도 개선(제21조), 지방의회 전문성 강화(제103조 제2항), 중앙지방협력회의 설치(제186조), 지방자치단체에 대한 적법성 통제 강화(제188조~제192조), 특별지방자치단체의 설치근거 마련(제12장 제199조~제211조) 등이다. 이중 특별지방자치단체는 규모가 작은 지방자치단체가 모여 공동협력을 통해 인구감소 문제 등 공통의 문제를 효과적으로 해결할 수 있는 제도로서 활용될 것이 기대되었다고 할 것이다. 그런대 특별지방자치단체 규정 자체에 있어서도 그 개념 자체의 한정적 규정, 특별지방자치단체의 본질 및 기존 관련 규정과 관련하여 부적절한 규정 위치 등의 문제점이 발견된다. 또한 제도 운영에 있어서도 도입시의 기대와는 달리 농산어촌 지역의 인구감소 문제 등의 공동해결을 위해 기초 지방자치단체간에 활용되기 보다는 광역지방자치단체간에 몸집을 키우는 초광역 특별지방자치단체를 만들려는 행태가 대두되어, 그에 따른 여러 가지 문제점도 제기되고 있다. 즉 첫째, 국가균형발전이라는 국가의 기본목표와의 부정합성 둘째, 기존 지방자치행정체계와의 부정합성 셋째, 추진 방식의 문제. 넷째, 목적과 수단간의 부정합성의 문제 등이다. 그러므로 기왕에 도입된 특별지방자치단체가 본래의 도입 취지에 맞게 잘 활용되어, 지방문제 특히 최근 인구감소 문제 등으로 지방소멸, 즉 공동체의 존립 자체가 위협받고 있는 농·산·어촌 지역의 문제를 해결하는 데 유용한 제도로서 기능할 수 있도록, 법제도적 및 그 운영상의 개선 노력이 필요하다.

영문 초록

Recently one of wordwide common problemes in OECD countries etc. is local population-decrease owing to the decreasing birthrate and outflow of local population to urban areas etc. Our country is also confronted with a serious problem of the local population-decrease and furthermore danger(crisis) of disappearence of local societies owing to it. In 2021 was there a total revision of korean Local self-government Law. It has a few new regulations for exemple, admission(allowance) of diversity of local autonomous entity(Art. 4), improvement of the modification-process of jurisdiction area-boundary(Art. 6), resident' right of opinion-presentation about legislation and revision etc of rule of local autonomous entity(Art. 20), improvement of resident' right of inspection-request(Art. 21), opening of activities of local assembly to resident(Art. 26), strengthening of professionality of local assembly(Art. 103), establishment of cooperation-conference inter state-local autonomous entity(Art. 186), strengthening of regality- control to local autonomous entity(Art. 188-192), and introduction of chapter of special local autonomous entity(chap. 12) etc. Later there were a few attempts to construct super great upper local autonomous entities in order to resolve the local population-decrease, furthermore danger(crisis) of disappearence of local societies and to increase self abilities in population and areas etc. for exemple, Pu-Ul-Geong Regional Union etc. since 2021. Then there are a few problems in the regulation of special local autonomous entity(chap. 12) and the attempt of construction of super great upper local autonomous entity. For exemple, in relation to the regulation of special local autonomous entity(chap. 12), narrow concept of special local autonomous entity, unproper position of regulation of special local autonomous entity(chap. 12), Then in relation to the attempt of construction of super great upper local autonomous entity, discordance with basic ideas of State, discordance with present system of local autonomous entity, unreasonableness of executing-method etc. Therfore, it is necessersary to improve the regulation of special local autonomous entity(chap. 12) and the way of using of the special local autonomous entity.
