국문 초록

현대사회는 예기치 못한 일들이 자주 일어나고 그 안에서 새로운 질서를 찾는 것을 당연시 하는 흐름이 고착화되고 있다. 삶속에서 어떤 사건이 일어날 때마다 여러 가지 의견이 나오지만 보편적으로 문제의 발생원인과 그에 대응하는 매뉴얼의 존재여부, 그리고 마무리를 통한 아쉬움과 문제에 대한 대책을 순서로 하여 정리된다고 할 수 있다. 최근의 여러 가지 사회적 관심을 가진 문제는 COVID-19로 인한 사회적 소외·단절로 인한 삶의 고립현상이 대표적이라 할 수 있고 한편으로는 화재로 인한 인명사고와 경제적 손실, 태양광설치로 인한 산림의 훼손과 장마 시 대규모 산사태로 이어지면서 나타난 것을 비롯하여 다방면에서 문제가 야기되는 대기 및 수질오염이 대표적이다. 그리고 단기적 이익을 추구한 사람들의 근시안적인 행태를 비판하거나 이러한 문제에 대한 충분한 대안과 준비 없이 일어난 일이라고 사후에 비판하는 모습을 본다. 이러한 현상을 통해 공통적으로 찾아 볼 수 있는 것은 예방적 사고의 결여요 예방을 소홀히 했다는 비판적 관점을 피할 수 없다. 다양하게 변하는 사회적 흐름 속에 적당한 목소리를 통해 보다 진일보되고 근본적인 대안을 제시하는 다방면의 전문가그룹의 의견이 필요하게 된다. 이러한 맥락 적 이해를 전제로 법의 정신을 실현하는 방법으로서 교정행정의 합목적성을 이루기 위한 다양한 관리·경영기법이 요구된다. 수용자를 위한 다양한 계획과 대안을 실천하는 법무부 교정당국과 민간인의 교정참여 현황 및 매뉴얼을 보면 현실적인 실용성이 결여된 부분을 찾을 수 있다. 현재 교정당국이 발간한 교정현황 매뉴얼의 전반적인 흐름은 특성상 예방보다는 사후대응에 초점이 맞추어져 있다. 행위의 결과에 대한 책임을 묻는 법의 특수성과 연관이 깊다. 현대의 교정행정은 예방적 교정행정에 많은 노력을 기울여야 하는 이유는 바로 재범률을 낮추는 유일한 대안이기 때문이다.

영문 초록

In modern society, unexpected things happen frequently and the trend of finding a new order in it is being taken for granted. Every time an event occurs in life, various opinions come out, but in general, it can be said that the cause of the problem, the existence of a manual corresponding to it, and the regret and countermeasures for the problem are arranged in order. The most recent problem with various social concerns is the phenomenon of disconnection of life due to social disconnection due to COVID-19. Air and water pollution, which causes problems in various ways, including those that have led to large-scale landslides in the city, is a representative example. And I see people criticizing the short-sighted behavior of those who pursued short-term gains, or post-mortem criticizing that it happened without adequate alternatives and preparations for these issues. What can be found in common through this phenomenon is the lack of preventive thinking, and the critical point of view that prevention is neglected cannot be avoided. The opinions of a multi-disciplinary group of experts are needed to urge more advanced and fundamental alternatives through a voice appropriate to these social trends. On the premise of this understanding, various management techniques are required to achieve the purpose of correctional administration as a method of realizing the spirit of the law. If you look at the current status of civilian participation in corrections and manuals from the Ministry of Justice and correctional authorities that implement various plans and alternatives for inmates, you can find a lack of practical practicality. Currently, the overall flow of the correctional status manual published by the correctional authorities is focused on post-response rather than prevention. It is closely related to the specificity of the law that holds responsibility for the consequences of actions. The reason why modern correctional administration should put a lot of effort into preventive correctional administration is that it is the only alternative to lowering the recidivism rate.
