영미법계의 법무보호와 민간참여 고찰

국문 초록

갱생보호사업은 기독교의 자선실천 사상으로부터 영향을 받아 대륙법계는 국가차원에서 시작되었으나, 영미법계는 민간에서부터 출발한 역사를 가지고 있다. 본 논문에서는 우리나라의 법무보호 발전을 위하여 영미법계 나라들의 갱생보호 민간참여 상황을 고찰, 다음과 같이 정리한다. 영국은 4년 단위 형사사법전략기획을 수립해서 기획내용을 실천하고 있다. 모든 현안이 지역사회와의 긴밀한 협력관계 즉 파트너쉽 활동 없이는 이루어지기 어렵다고 보며 재범감소를 위한 협력적 활동 차원에서 직업교육훈련 등을 더 중시한다. 형사사법 문제와 관련해서는 비영리단체와의 협업이 중요하기에 재범감소 활동을 하는 서비스제공자들에게 잉여금을 지불하는 시스템 시행한 바 있다. 형사사법 시스템에서 공공영역과 사적 영역의 제3영역이라고 불리기도 하는 자발적 지역사회 영역(VCS)에는 캠페인, 예술상담, 재정, 중독치료 등 다양한 형태가 있다. 형사사법시스템에서 VCS가 지역의 중심이며, 이러한 지역중심적인 VCS의 특성이 정부에 대한 불신이 많은 출소자들에게는 신뢰로 다가갈 수 있는 순기능을 발휘하는 면이 있다. VCS의 활동 중에서는 자원봉사자 참여가 중요하고 그 중에서는 특히 멘토링(민간단체 크링스에 위탁한 과제에는 재범감소 자원봉사 멘토링네트워크 설립, 지역내 범죄자와 함께 일하기 및 훈련 지원 프로그램 개발, 관리위원 대상 훈련 교육, 수용자 가족을 위한 활동 프로그램 진행, 법무부와 협력 멘토 모집정책 개발, 출소 후 출소자들에게 중단없이 멘토링이 제공될 수 있는 방안 개발, 자원봉사자 훈련기회 확대방안 개발, 교도관 및 보호관찰관 대상 훈련 지원 제공 개발) 등의 활동이 중요한 것이 사실이다. 물론 VCS는 더 안전한 지역사회를 위해서 정부와 지방 당국에 대해서 다양한 지원체계 네트워크를 형성하도록 하며 재범방지를 위해 적극적으로 돕는 역할을 지표(보호관찰 중인 성인 재범률, 젊은 범죄자 재범률, 감시 우선순위 범죄자 재범률)까지 고려하며 다양한 종류의 각종 서비스, 그리고 다양한 종류의 재범감소를 위한 활동 등을 진행하고 있고 정부는 점점 확대되고 있는 제3지대(the third sector) 영역을 민주주의와 지역 연합이라는 관점에서 보고 사회경제 재생산이라는 보고서를 통해 협력방향을 제시, 특히 재범과 관련해서는 전술한 공공서비스조약을 통해 방향을 제시한 바 있다. 즉 지역사회를 안전하게 형성하기 위해 재범감소를 핵심사안으로 정한 것이다. 법무부(Ministry of Jutice)는 강점(유연 비관료적이고 대응성이 높아 사람의 필요를 충족시키고 실행에 옮기는 점과 신속성, 신뢰성이 높은 점, 조직자간 협력가능성, 서비스제공에서 이용자 참여지원이 있는 점, 개인서비스 접근을 지원하는 점, 다수 자원봉사자를 참여시켜 자원수집 가능한 점, 소수집단 신앙집단을 포함하는 점 등)을 인정, 이에 부응하여 제3영역 전략(The Third Sector Strategy)을 발간, 협력 의지를 피력(사회적 기업 장려, 공공서비스 전환, 지역사회 역량강화, 캠페인 활동, 시도한 바 있다. 제3영역 전략을 통해 사법영역에 있어서도 제3영역(자발적 지역사회조직, 사회적 기업, 협동조합과 상호조직, 자조집단, 자선단체, 신앙기반단체, 여성단체, 기간시설, 상부기구, 주거협회, 독립자선기부자단체 등) 기여도를 높이고자 한다.…

영문 초록

The rehabilitation protection project was influenced by the idea of Christian charity practice, and the continental legal world began at the national level, but the Anglo-American legal world has a history of starting from the private sector. In this paper, for the development of legal protection in Korea, the situation of private participation in rehabilitation protection of Anglo-American law countries is reviewed and summarized as follows. The UK has established a four-year criminal justice strategy plan and is implementing the contents of the plan. All pending issues are difficult to achieve without close cooperation with the local community, namely partnership activities, and vocational education and training are more important in terms of cooperative activities to reduce recidivism. Regarding criminal justice issues, since collaboration with non-profit organizations is important, a system has been implemented to pay surpluses to service providers engaged in recidivism reduction activities. In the criminal justice system, the voluntary community area (VCS), also called the third area of the public and private areas, has various forms such as campaigns, art counseling, finance, and addiction treatment. In the criminal justice system, VCS is regional-centered, and this characteristic of regional-centered VCS has a positive function that can approach trust to prisoners with a lot of distrust in the government. Volunteer participation is important among VCS's activities, especially mentoring (establishing a volunteer mentoring network entrusted to private organization Klings, developing work and training support programs with criminals in the region, training for managers, developing activity programs for families of inmates, and expanding mentoring. Of course, the VCS is conducting various services and activities to reduce various types of recidivism, taking into account indicators (adult recidivism rate under probation, young criminal recidivism rate, surveillance priority criminal recidivism rate) for safer communities, and the government is increasingly expanding third district. In other words, in order to safely form the local community, the reduction of recidivism was set as a key issue. The Ministry of Justice acknowledges its strengths (the flexibility and responsiveness to meet and implement people's needs, high speed and reliability, cooperation between organizers, support user participation in service provision, support for personal service access, and third strategy area. Through the third area strategy, we aim to increase the contribution of third areas (voluntary community organizations, social enterprises, cooperatives and mutual organizations, self-help groups, charities, faith-based organizations, women's organizations, infrastructure, upper organizations, housing associations, independent charity organizations, etc.).…
