『한비자』의 통치술 체계에 대한 연구

국문 초록

『한비자』는 전국시대 군권(君權) 장악·유지와 부국강병을 위한 통치술을 담고 있다. 법가 사상의 집대성이며, 노자의 사상을 비롯한 다른 제자백가 사상들과도 융합되어 있다. 『한비자』를 전반에서 들여다보면 ‘통치술의 체계’가 드러난다. 『한비자』속에 담겨 있는 통치술은 ‘내적 지향 단계’로부터 ‘외적 지향 단계’를 통하여, ‘통치의 목표 단계’에 이르는 과정으로 체계화되어 있다. 우선 내적 지향 단계에서는 군주가 통치자로서 자신을 대상화하면서 자신이 내적으로 갖추어야 할 태도와 상태를 제시한다. 이에 해당하는 요소들은 전식(前識) 배격, 허정·무위(虛靜·無爲), 명(明), 조복(蚤服)이 있다. 다음은 외적 지향 단계로서 내적 지향 단계의 완성과 유지를 전제로 하며 통치자(군주)가 통치를 행함에 있어 사용해야 할 수단과 방법을 제시한다. 이 단계에는 직접적인 접근 방법인 세(勢), 법(法), 술(術), 상(賞)·벌(罰), 형명참동(形名參同)과 간접적인 접근 방법인 미명(微明)이 있다. 끝으로 통치의 목표 단계에서는 통치를 통하여 도달하고자 하는 궁극적인 목표를 제시한다. 이 단계에 해당되는 요소는 습상(習常)이다. 본 연구의 학술적 가치는 『한비자』사상의 주요 개념들 각각에 대한 단편적인 탐구를 넘어『한비자』사상에 담겨 있는 통치술의 체계성을 밝혀 유기적이고 논리적인 의미를 부여하였다는 점에 있다.

영문 초록

『Hanbija(韓非子)』 contains the techniques of seizing and maintaining of political authority, national property and military power during the Warring state period. It is the codification of the ideology of the law, and it is fused with the thoughts of 『Noza(老子)』 and the other schools of thoughts. If we look at the thought of 『Hanbija(韓非子)』 from the whole contents, 'the system of governmental arts' melted in it is revealed. 'The system of governmental arts' contained in 『Hanbija(韓非子)』 can be proceduralized from 'the inner-directing stage' to 'the external-directing stage' and toward 'the goal stage of governance'. First of all, the 'inner-directing stage' refers to objectifying himself as a ruler, means the attitude and condition that the monarch should have internally toward himself. Factors corresponding to this are the rejection of Jeonsik(前識), Heojeong·Muwi(虛靜·無爲), Myung(明), and Jobok(蚤服). The following is 'the external-directing stage', which refers to the way of approach and the means that the ruler(monarch) should use to rein, and makes a promise of the completion of the inner-directing stage. This includes the directing approaches such as Se(勢), Beob(法), Sul(術), sang·punishment(賞·罰), Hyungmyungchamdong(形名參同), and the indirecting approach such as Mimyung(微明). Finally, the goal stage of governance refers to the goal to be reached through the governance. This is a Seupsang(習常). The meaning of this study is to give an organic and logical meaning by revealing 'the system of governance' contained in the thought of 『Hanbija(韓非子)』 beyond a fragmentary inquiry into each of the main elements of the thought of 『Hanbija(韓非子)』.
