주민자치에 대한 이해와 오해

국문 초록

2013년부터 시범 운영되고 있는 주민자치회가 제 역할을 하지 못하고 있다는 비판에 직면해 있다. 이 글은 주민자치회가 제 역할을 하지 못하게 된 근본 원인이 지방자치, 주민자치, 그리고 주민자치회에 대한 오해에 기인한다고 인식한다. 이를 확인하기 위하여 미셸 푸코가 제시한 통치성(governmentality) 개념을 원용했는데, 통치성을 효과적인 분석 도구로 활용하기 위하여 통치성 개념을 구성하는 6개의 핵심 요소를 활용했다. 통치의 총체성(ensemble), 통치의 주체(relationship of self to self), 통치의 방식(parrhesia; manifestation of truth), 통치의 구현(surface of contact), 통치의 도구(reason; knowledge), 다층성(multilayered)이 통치성을 구성하는 핵심 요소이며, 분석 결과 첫째, 현재 운영되고 있는 주민자치회는 자치(self-governing)보다는 지배(being governed)에 더 근접하다고 판단된다. 둘째, 제시된 3개의 모델을 푸코의 기준에 적용해보면 현재의 협력형 주민자치회 운영은 주민자치와 가장 부합되지 않은 것으로 평가되어 향후 통합형 주민자치회, 주민조직형 주민자치회로의 전환을 기대해 본다. 셋째, 자치를 위한 인구규모의 적정성을 감안하면 읍·면·동 수준에서보다는 통·리·반 수준에서의 주민자치회 운영이 더 적합할 것이라는 평가다. 푸코의 기준을 원용한다면 향후 적어도 통·리·반 수준에서의 통합형 주민자치회의 설치 및 운영이 기대된다.

영문 초록

Misunderstanding on the Concept of Local Self-Governing, Resident Self-Governing Board and Its Consequences: Referring to the Concept of ‘Governmentality’ of M. Faucault. The paper confirms that the resident self-governing committee of Korea faces difficulties of being settled down yet. The author doubts that they misunderstand the concept of local autonomy, self-governing. They may believe that it would be possible in promoting the self-governing system for the state to rely on local authorities. Consequently, they put more personnel and financial resources on local authorities, which have been taking over authority and accountability from the national government. The process accelerates those local people to be located around the periphery. They are still the being governed, not the governor. Those 6 employed elements of Faucault’s governmentality indicate that the current resident self-governing board has been derailed from the right track. The analysis also proposes that the so-called cooperative model would be recommended among 3 proposed models of resident self-governing board with regard to various constraints. In the near future the resident led model should also be positively reviewed as the standard guidance be amended again.
