국문 초록

이 연구는 국가교육위원회의 설립 배경 및 관련 법령 정비, 국교위 구성, 국교위 출범의 의미 등을 조사·분석하고, 국교위 관련 주요 쟁점 및 문제점을 검토하며, 향후 입법적·정책적 개선과제를 제시하였다. 국교위 출범의 의미로는 주요 교육정책 결정 시 사회적 합의 등의 중시, 교육과정의 기준을 정하는 권한을 국교위로 이관, 주요한 교육정책 결정과정에 국민의 직접 참여, 교육개혁 등에 대한 국회의 영향력과 책임 증대 등이다. 주요 쟁점으로는 교육계획 등의 수립 시 교육부와의 기능 중복, 행정기관으로 설치되는 위원회의 한계와 조직·정원의 부족, 교육 전문성 부족과 지방교육 자치분권에 대한 역할 수행 미흡, 새 교육과정의 미흡한 심의·의결 우려 등이 제기되었다. 이를 개선하기 위한 방안으로 교육부의 5년 이내 기본(종합)계획 수립 시 국교위의 중장기 발전계획에 따르도록 ｢국가교육위원회법｣ 개정, 교육전문가 채용 및 정원·조직 확충을 위한 ｢국가교육위원회 직제｣ 개편, 교육행정기관 간의 기능 분담 체계의 명확한 정립, 국교위의 내실 있는 새 교육과정 심의·의결 방안 마련, 국회입법조사처 등 국회연구기관에 교육전문가 증원 등을 제안하였다

영문 초록

This study investigates the establishment, composition, and meaning of the launch of the National Education Commission and the arrangement of related laws. It reviews major issues and problems related to the Commission and presents future legislative and policy improvement tasks. The main issues include (a) duplication of functions with the Ministry of Education when developing educational plans, (b) limitations of the Commission as an administrative agency, its relatively small size given the heavy duties it has been tasked with, (c) lack of educational expertise and insufficient performance for local education autonomy and decentralization, and (d) concerns about insufficient time to evaluate and decide on the 2022 revised national education curriculum. To resolve these problems, first, it is necessary to revise the National Education Commission Act to comply with the mid- to long-term National Education Development Plan of the National Education Commission when the Ministry of Education creates its Five-year Basic or Comprehensive Plan. Second, the Decree on the Organization of the National Education Commission needs to be revised to recruit education experts and expand the organization and its scope. Third, the establishment of a clear system for the division of functions among educational administrative agencies is necessary. Fourth, alternative plans should be prepared for deliberation and decision on the new, revised curriculum. Finally, it suggests to increase the number of education experts in the research institution of the National Assembly such as Natonal Assembly Research Service.
