국문 초록

이 논문은 그 제목을 신축건물의 일부 층 완성과 구분소유권의 취득이라고 정하였다. 장래에 어떠한 법적 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측하는 것은 일정한 한계가 있다. 그러나 사회질서를 규율할 목적으로 만들어진 것이 법 제도이므로, 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수 있는 방안들이 꾸준하게 모색될 필요가 있다. 특히 구분소유제도는 비교적 최근에 정립된 제도라는 점에서 종래에 발생한 문제점들을 면밀하게 파악한다면, 장래에 정립될 구분소유제도는 조금 더 합리적이고 실질적 정의에 합치될 가능성이 높다. 이 논문에서 저자는 집합건물의 신축과정에서 구분소유권이 성립하는 시점에 대하여 검토하였는데, 집합건물 1층의 독립된 부분이 완성되면 그 1층의 독립된 부분에 대한 구분소유권이 성립할 수 있을 것으로 보인다.

영문 초록

The title of this thesis is ‘Completion of Some Floors of a New Building and Acquisition of the Divided Ownership’. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Since the divided ownership system is something that is being newly developed, a thorough examination of past problems can lead to a future's adhesion contract system that is more rational and accords with substantial justice. I reviewed the timing of the establishment of divisional ownership in the process of new construction of a collective building. For example, I think that when the independent part of the first floor of a collective building is completed, separate ownership of the independent part of the first floor is established.
