국문 초록

본 연구의 목적은 국가정보원법 개정 및 현 국가보안법의 폐지 가능성에 따라 우리나라의 안보형사법체계를 재정립하기 위한 기준을 마련하기 위함이다. 이에 따라 우리나라 안보형사법 체계변화에 대한 배경을 명확히 이해하고 안보형사법이 변해야 할 필요성을 인식함으로써 우리나라 안보형사법의 체계를 살펴보고 국가정보원의 순수 정보기관 전환 및 국가보안법 폐지 가능성에 따른 문제점들을 살펴본 후 향후 우리나라 안보형사법 체계변화가 어떠한 형태로 전환해야 하는 지에 대해 고민을 해야 할 것이다. 그러므로 만약 국가보안법이 폐지된다면 우리나라 현실에 맞는 ‘新국가안보법’을 제정하여 언제 일어날지 모르는 북한의 도발 및 전 세계적으로 정치, 민족갈등, 종교문제로 인해 위협이 되고 있는 각종 테러와 경제, 산업, 환경, 자원, 기후 등의 문제로 인해 나라별 갈등을 억제할 수 있도록 국가가 사전에 나서서 예방 및 대응활동을 적극적으로 해야 할 것이다. 안보형사법은 국가의 안보를 지키고 또한 지탱하는 기둥의 역할을 한다. 따라서 국가정보원의 순수 정보기관 전환 및 국가보안법 폐지가 된다는 가정 하에 안보형사법 체계변화에 대한 배경 및 필요성을 살펴보고 국가보안법이 폐지가 될 경우 향후 우리나라만의 새로운 안보형사법체계가 어떻게 구축되어야 하는 지에 대해 국가보안법과 어느 정도 유사한 법적 성질을 가지고 있는 테러방지법을 살펴본 후 우리나라 여건에 맞는 新국가안보법이 제정되기 위한 기준을 마련하고 관련 내용이 어떻게 구성되어야 하는지에 대해 본 연구의 의미를 두고자 한다.

영문 초록

The purpose of this study is to re-establish Korea's security criminal law system according to the revision of the National Intelligence Service Law and the possibility of repealing the current National Security Law. Accordingly, by clearly understanding the background of changes in the security criminal law system in Korea and recognizing the need for changes in the security criminal law, the system of the security criminal law in Korea was examined, and problems caused by the conversion of the National Intelligence Service to a pure intelligence agency and the possibility of abolition of the National Security Law were examined. It is necessary to recognize the need for a change in the security criminal law system. Therefore, under the assumption that the investigation authority and the National Security Law will be abolished according to the revision of the National Intelligence Service Law, the background and necessity of the change in the security criminal law system will be examined, and the national security criminal law, the Criminal Law, the National Security Law, the Anti-Terrorism Law, etc. will be compared and related foreign laws. The purpose of this study is to examine how a new security criminal law system unique to Korea should be established when the National Security Law is repealed through consideration.
