유엔체제 ‘보호책임(RtoP)’의 제도화 특성과 북한인권 문제의 분석적 함의

국문 초록

유엔체제 하의 국제인권 문제는 유엔 창설 초기 국제인권규범(세계인권선언), 경제사회이사회(인권위원회), 사무국(OHCHR) 및 총회(인권이사회)를 거쳐, 2005년 이후 보호책임(RtoP)으로의 특성화를 계기로 안보리와의 이슈 연계성을 보이며 공진해 왔다. 특히 보호책임과 관련하여 유엔 총회는 안보리와 함께 보호책임의 하위의제들을 중심으로전문화된 예비적 규범의 기반을 축적해 왔다. 이 과정에서 전통적인 국가안보 중심의 국가주권과 인간안보 중심의 보호책임 간 상충적 긴장이발생하였고, 북한인권 문제 또한 안보리 밖에서 진행되어 온 비구속적선언 등을 통한 유연적 접근에서 벗어나, 점차 안보리의 강제적 집단행동과의 연계를 통한 국제사회의 강경한 대응에 직면해 있는 상황이다. 이런 배경 하에서 본 연구는 유엔체제에서 제도화되고 있는 보호책임의일반원칙 및 행동지침들의 관점에서, 북한인권 문제가 지닌 함의를 관찰·분석하기 위한 시도로 수행되었다. 이를 위해 유엔 보호책임의 제도화 과정을 예비·제도기반 단계와 하위의제별 제도화 단계로 구분하여주요 특성을 검토한 후, 유엔의 북한인권에 대한 평가와 북한의 대응구조를 토대로 인권의 문제영역과 보호책임의 구성요소에 준거하여, 보호책임과 관련한 북한인권 문제의 분석적 함의를 도출하고자 한다.

영문 초록

Human Rights issue under the UN system has coevolved from international norms, ECOSOC(Commission of Human Rights), Secretariat (OHCHR) and General Assembly(Council of Human Rights) into Security Council through the issue-linkage with the RtoP. Especially, Since 2009 UN GA and SC has dedicated their coordinated decision-making to accumulating more concrete and professional norms and action guidances of sub-agenda of the RtoP. In these overall process, conflicting tensions were witnessed between state sovereignty based on national security and the Right to Protection on Human security. And North Korea’s Human Rights problem was also confronted with more resolute response by coercive collective action from international community. This study is designed to analyze diverse implications of North Korea’s problem of human right in terms of institutional features of the United Nations RtoP regime. The analysis of the features are implemented in the preliminary and fundamental institutionalized phases respectively. In conclusion, based on the present assessment of North Korea’s situation of human rights by the UN and North Korea’s response to it, the study tackles significant analytic implications of the problem in the RtoP viewpoints.
