규제협상의 성공조건

국문 초록

‘한걸음 모델’은 신사업 도입에 따른 이해관계 충돌을 규제협상 방식으로 해결하기 위해 체계적으로 기획된 정부 차원의 첫 시도라 할 수 있다. 규제협상은 미국을 비롯하여 여러 선진국에 활용되고 있는 대표적 규제갈등 예방기제이다. 본 연구는 2020년 ‘한걸음 모델’이라는 이름 하에 수행된 세 가지 사례(①농촌민박, ②도시민박, ③산림관광)를 비교분석하여 한국사회에서 규제협상의 가능성과 과제에 대해 탐색하는 것을 목적으로 한다. 특히, 본 연구는 전략적 선택이론을 기반으로 정부기관의 능동적 역할에 초점을 맞추어 규제협상의 성공조건을 분석하였다. 분석 결과, 규제협상은 한국사회에서 정부가 선택할 수 있는 규제정책 결정방식의 하나로 충분히 전략적 선택의 대상이 될 수 있음을 확인하였다. 또한 성공적 규제협상을 위해서는 규제협상을 규제정책 결정방식으로 선택하기 전에 정책특성요인을 심도있게 검토해야 하며, 협상위원회의 중립적 구성뿐 아니라 대표성이 확보된 구성이 중요하고, 협상위원회의 운영과 관련해서는 비전 공유와 합리적 성과 수준의 조정도 필수적이다. 더불어 정부부처 간 협력체제의 구축과 ‘한걸음 모델’ 주관부처는 규제협상 전 과정을 관장하는 과정관리자로서의 역할을, 규제부처는 합리적인 규제정책의 개발에 초점을 맞춘 이해관계자로서의 역할을 분담하여 수행하는 것이 바람직하다 할 것이다.

영문 초록

The ‘hangeoreum model’ can be said to be the first attempt at the government level systematically designed to resolve conflicts of interest following the introduction of new businesses through regulatory negotiation. Regulatory negotiation is a representative regulatory conflict prevention mechanism used in the United States and other advanced countries. The purpose of this study is to explore the possibilities and challenges of regulatory negotiations in Korean society by comparing and analyzing three cases carried out under the name of ‘hangeoreum model’ in 2020. In particular, this study analyzed the conditions for success in regulatory negotiations by focusing on the active role of government agencies based on the strategic choice theory. As a result of the analysis, it was confirmed that regulatory negotiations can be sufficiently subject to strategic choices as one of the regulatory policy decisions that the government can choose from in Korean society. In successful regulatory negotiations, it is necessary to in-depth review of policy characteristics before selecting regulatory negotiations as a method for determining regulatory policy. It was found that sharing a vision and adjusting the level of reasonable performance are very important. In addition, it is desirable to establish a cooperative system between government department and to play the role of the convener department as a process manager in charge of the entire regulatory negotiation process, and the regulatory department as a stakeholder focusing on the development of rational regulatory policies.
