임대보증금보증제도의 법경제학적 고찰

국문 초록

민간임대주택에 관한 특별법 제49조 규정의 임대보증금보증 의무가입은 도입 당시부터 논란이 많았다. 경제적 수혜를 받는 임차인이 아닌 임대등록사업자가 보증에 의무적으로 가입해야 하고, 보증료를 부담해야 하며, 가입의무 위반 시 형사처벌까지 받기 때문이었다. 따라서 그것은 법적용의 과중성과 형평성의 문제가 제기되고, 도덕적 해이의 우려가 지속되어 왔다. 본 연구는 이 제도가 갖고 있는 문제점을 법･경제학적 관점에서 고찰한 후, 법의 형평성을 유지하고 사적자치 원칙 훼손을 최소화 하기 위한 개선방안을 제시하였다. 첫째, 영세한 개인매입 임대사업자의 보증가입 의무를 면제하거나 완화하고 임차인이 선택적으로 보증가입하도록 한다. 둘째, 시세차익을 올리는 갭투자를 방지하기 위해 보증한도를 현실에 맞게 낮춰야 한다. 셋째, 전세가율이 높고, 세 부담이 큰 다주택자에 대해 적정한 부채관리를 해야 한다.

영문 초록

The mandatory subscription of lease deposit guarantees under Article 49 of the Special Act on Private lease Housing has been controversial since its introduction. This is because lease registration businesses, not tenants who receive economic benefits, are obligated to sign up for guarantees, pay guarantee fees, and even face criminal punishment for violating their subscription obligations. Therefore, problems of excessive legal use and equity have been raised, and concerns about moral hazard have continued. After considering the problems of this system from a legal and economic point of view, this study suggested improvement measures to maintain legal equity and minimize damage to the principle of private autonomy. First, the obligation of small private purchase lease businesses to subscribe to guarantees is exempted or alleviated, and tenants are required to selectively subscribe to guarantees. Second, the guarantee limit should be lowered to suit the reality to prevent gap investment that raises market profits. Third, appropriate debt management is needed for multi-homeowners with high lease rates and high tax burdens.
