국문 초록

가정이라는 폐쇄적인 공간 안에서 발생하는 아동학대는 범죄행위의 발견이나 조기개입에 어려움이 있고, 때로는 형사적 개입도 늦어진다. 또한 아동학대범죄는 주택이라는 사적 공간에서 발생하는 심각한 범죄행위로 발전할 가능성이 있고, 일회성 범죄에 그치지 않고 지속적으로 발생한다는 점에서 사회적 폐해가 크다. 우리나라 대부분의 부모들은 자녀들을 부양함에 있어서 건강한 성장을 위해 최선의 노력을 다하고 있으나, 일부 부모는 가정폭력과 같은 아동학대 등의 범죄행위를 통하여 오히려 자녀들의 사회화에 악영향을 끼친다. 아동학대의 문제가 심각한 사회적 문제로 대두되게 된 것은 비교적 최근의 몇몇 사건을 통해서 사회적 공분의 대상이 된 이후 반복적으로 발생하고 있다. 아동학대는 그 발생 원인이 다양하며, 복합적인 형태로 발생할 뿐만 아니라 대부분 가족 간에 지속적으로 발생하는 반면, 아동보호는 원칙적으로 원가정보호를 목적으로 한다는 점에서 그 대응이 쉽지 않다. 그동안 우리 사회는 아동학대를 가정 내 훈육으로 인식하는 잘못된 관행이 존재하였으며, 사회적으로 이슈화된 아동학대 사건이 발생할 때마다 한시적으로 관심의 대상이 된다는 점에서도 문제가 있다. 즉, 아동학대가 우리 사회에 아직도 빈번하게 발생하고 있고, 심각한 사회문제가 됨에도 불구하고 이를 해결할 실마리를 우리는 알지 못한다. 아동학대가 발생한 경우에 그 법적 대응방안으로 사법적으로는 친권상실, 형사법적으로는 ｢아동학대처벌법｣에 의한 형벌의 선고를 들 수 있지만, 가족 간 문제된 법률문제인 점에서 그 한계도 있다. 아동학대가 발생한 경우에 법적 대처방안은, 그 논의의 핵심을 부모와 자녀를 분리시킬 것인가, 분리시킨다면 언제까지 분리시킬 것이며, 분리 후 다시 아동학대의 경험이 있는 부모에게 자녀의 양육을 다시 맡길 수 있는 것인가, 등에 있다. 논문의 연구목적은 다음과 같다. ⅰ) 아동에 대한 부모의 훈육과 학대에 대한 구별기준을 밝히는 것, ⅱ) 아동학대에 대한 사전적 예방대책과 아동학대가 발생한 경우에 그에 대한 법적 대처방안, ⅲ) 아동학대를 줄이고자하는 입법적 대안의 탐색, ⅳ) 아동학대가 발생한 가정의 부모와 자녀의 분리 후 다시 자녀가 아동학대를 저지르는 부모에게로 다시 복귀하는 원가정복귀원칙의 문제점과 그 개선방안의 마련, ⅴ) 아동의 복리를 위한 궁극적인 법적 대처방안의 마련, 등에 있다.

영문 초록

Child abuse, which occurs in a closed space called home, makes it difficult to detect or intervene early, and sometimes criminal intervention is delayed. In addition, child abuse crimes are likely to develop into serious criminal acts that occur in the private space of housing, and social harm is great in that they do not stop at one-time crimes but continue to occur. Most parents in Korea are doing their best to grow healthy in supporting their children, but some parents adversely affect their children s socialization through criminal acts such as child abuse such as domestic violence. The problem of child abuse has emerged as a serious social problem since it became the subject of social resentment through several relatively recent events. Child abuse has various causes, and not only occurs in complex forms, but also occurs mostly among families, but it is not easy to respond in that child protection is aimed at protecting cost information in principle. Until now, our society has had a wrong practice of recognizing child abuse as discipline at home, and there is also a problem in that it is temporarily of interest whenever a socially controversial child abuse case occurs. In other words, even though child abuse still occurs frequently in our society and becomes a serious social problem, we do not know the clue to solving it. The scope of the study in this article is the loss of parental authority legally and the sentence of punishment under the Child Abuse Crime Penalty Act in criminal law, but there is also a limitation in that it is a family legal issue. In the event of child abuse, legal measures include whether to separate parents and children from the core of the discussion, how long will it be separated if separated, and whether it is possible to entrust the child s rearing to parents with experience of child abuse again. The research objectives of the thesis are as follows. ⅰ) Revealing the criteria for distinction between parental discipline and abuse of children, ⅱ) proactive preventive measures against child abuse, ⅲ), exploring legislative alternatives to reduce child abuse, ⅳ) improving the cost of returning children to parents who commit child abuse.
