한･중･일 부동산등기법의 비교연구

국문 초록

부동산은 개인에게 있어서 재산적 가치가 큰 재산권으로, 이러한 개인의 재산권을 보호하기 위한 제도적 장치가 부동산등기이다. 이러한 부동산등기법은 국가의 사회적･문화적 상황 및 법체계 등에 따라 입법체계 및 내용 등이 다양한 형태로 나타날 수 있다. 한･중･일 부동산등기와 관련하여서는 개별적인 부동산등기의 내용에 대한 규정이나 해석론에 있어서는 다양한 견해가 존재한다. 다만, 한･중･일의 부동산등기법의 입법형식과 관련하여서도 유사한 점과 차이점이 있다. 그런데, 부동산등기법은 부동산등기의 절차 등에 관한 사항을 규정하고 있기 때문에 가치중립적 특성이 강하다. 이로 인하여 한･중･일 상호간에 법체계에 대한 접근이 용이하다. 그리고 한･중･일의 부동산등기법에 대해 단일법체계와 분법체계에 대한 장･단점의 고려가 필요하다. 이를 통하여 상호 법제발전경험의 공유를 통해 한･중･일간에 유사한 부동산등기법의 입법체계 구축을 검토할 필요가 있다.

영문 초록

Real estate is a property right of great property value to an individual, and the registration of real estate is an institutional mechanism for protecting such individual property rights. Such real estate registration methods may appear in various forms, such as legislative systems and contents, depending on the social and cultural situation and legal system of the country. The registration of real estate in Korea, China, and Japan has various views on the regulations and interpretation of the contents of individual real estate registration. However, the real estate registration method stipulates matters concerning the registration process of real estate, so the value-neutral characteristics are strong. As a result, it is easy to access the legal system between Korea, China and Japan. In addition, it is necessary to consider the merits and demerits of the single legal system and the divisional system for the real estate registration method of Korea, China and Japan. It is necessary to consider establishing a legislative system of similar real estate registration laws between Korea, China, and Japan through the sharing of mutual experience in the development of legislation.
