국문 초록

본 연구는 2013년 신안염전노예사건이 드러난 이후에도 반복되고 있는 소위 현대판 노예 사건, 발달장애인(특히 경한 정도의 지적장애인)을 피해대상으로 하는 노동력 착취 사건의 근절을 위한 구제방안 강화를 내용으로 한다. 전체적인 골자는 (사)장애우권익문제연구소의 ‘울력과 품앗이 프로젝트’ 최종보고서(장애인 노동력 착취 형사 처분 사례에 관한 질적 분 석 및 개선방안 모색을 위한 연구)를 기반으로 하여, 장애인 노동력 착취 사건에 대한 관계 법령에 근거한 구제절차 현황 및 실무상 한계점(비교적 최근 2018년 3월 구제조치가 진행 된 ‘잠실야구장 노예사건’을 중심으로)을 살피고, 국내외 입법례와 현황을 참고하여 장애인 학대범죄의 처벌 등에 관한 특례 제정의 필요성 및 구체적인 구제방안(장애인 대상 범죄 통계작성 및 공표의무, 근로감독관 조사 배제, 양형 상향, 경찰 전담조사팀, 검찰의 결정 전 조사, 전담재판부, 진술조력인, 공소시효 적용 예외 등)을 제시한다.

영문 초록

This study calls for strengthening relief plans to eradicate labor exploitation of workers with developmental disability(especially those with mild intellectual disability) and the so-called modern slavery cases, which has been repeated since the 2013 Shinan Salt Farm slavery case. The overall idea is to study the current status and practical limitations of relief procedures based on related laws on labor exploitation of disabled workers(focusing on a relatively recent case, Jamsil Baseball Stadium Slavery Case , on which actions were taken in March 2018) referring to Disability Rights Research Institute s final report on Uullyeok and Poom-a-si Project (a study for the qualitative analysis on criminal cases of labor exploitation of workers with disability and seeking improvement methods), and to suggest the necessity of enacting the exemption law concerning the punishment of disability abuse and specific relief plans(obligation to produce and publish statistics of crimes against the disabled, exclusion of labor supervisors, higher sentencing, operation of a task force, investigation before the prosecution s decision, exclusive court, statement assistant, exceptions to the statute of limitations, etc.) referring to domestic and foreign legislative examples and current status.
