국문 초록

디지털 성범죄는 디지털 매체를 이용하여 대상자의 신체나 성행위 장면을 촬영하고 이를 유포 혹은 유포한다는 협박을 하거나 이를 저장, 전시 하는 등 사이버 공간에서 행하여지는 성적인 침해를 의미한다. 디지털 성범죄는 성적 침해 내용이 포함된 콘텐츠를 제작한 뒤 이를 소지·유포하여 수익을 얻는 단계를 일반적으로 보이고 있다. 유형으로는 제작행위에 집중하는 콘텐츠 제작형, 다른 사람이 제작한 콘텐츠를 수집하여 관람 혹은 유포하는 수집·유포형, 범죄행위를 오프라인 공간으로 이어가는 오프라인 연계형, 우발·충동적으로 제작하고 후에 이를 복수 등 범죄적으로 활용하는 우발·복수형 그리고 모든 유형이 혼합된 혼합·직업형으로 구분할 수 있다. 디지털 성범죄를 통제하기 위해서는 모든 대응 체계를 통합하여 관리하는 총괄통제시스템 구축, 웹하드 업체에 대한 관리강화, 전담 특별사법경찰제 도입이 필요하다. 또한 민간 영역과의 공조시스템을 구축하기 위해서는 결제에 관여하는 신용카드사와의 협력 및 시민 감시단 등의 민간영역 활성화, 미성년 학생들에 대해 디지털 성범죄 교육을 강화하여 성교육의 현실화를 기하도록 한다. 그러나 기본적으로 바탕이 되어야 하는 것은 디지털 성범죄 피해자가 사회적 비난이라는 또 다른 피해까지 감수해야 하는 사회문화적 환경을 변화시켜야 한다. 또한 디지털 성범죄 피해자에 대한 지원 프로그램이 필요하고 특히 미성년 피해자에 대한 장기적인 관리가 필수적이라고 할 것이다.

영문 초록

Digital sex crimes refers to sexual crimes that occur in the cyberspace through taking the images of other people’s bodies and sex scenes using digital devices before threatening, storing or displaying them. Digital sex offenders generally make profits by producing, possessing and distributing sexual contents. There are several types of sex offenders, offenders who focus on producing sexual contents, offenders who work on collecting and distributing the contents, offenders who commit crimes offline, offenders who accidentally and impulsively produce the contents and later take revenge on someone, professional offenders. In order to crack down on digital sex crimes, it is necessary to establish a comprehensive control system monitoring to respond to all conditions, to strengthen the management of webhard businesses, and to introduce the special judicial police officer. Cooperation with the private sector also plays an important role to realize zero digital sex crime society through involving credit card companies in payment, revitalization of civic monitoring, and providing digital sex crime prevention education to minors. Above all, we must change the socio-cultural environment in which digital sex crime victims are subject to social criticism. In addition, a wide range of support programs should be offered to digital sex crime victims along with especially a long-term management for minor victims.
