국문 초록

이 연구의 목적은 공군제20전투비행단 성폭력사건을 국가젠더폭력으로 진단하고 성인지적 관점에서 바람직한 대응방향을 모색하는데 두었다. 공군성폭력 사건의 쟁점을 살펴보면 첫째, 성폭력사건 처리절차에서 성인지적 접근태도가 결여되었고, 둘째, 부실수사와 사건은폐로 국가젠더폭력의 전형을 드러냈으며, 셋째, 피해자지원체계 붕괴와 전문적 역량을 갖추지 못했으며, 넷째, 젠더폭력에 대한 군형사사법체계의 한계를 드러냈다. 이와 같은 문제점 해결을 위한 성인지적 관점의 정책적 제언으로 첫째, 군대성폭력 사건을 젠더폭력으로 간주하고 성인지적 형사사법시스템을 적용하여야 한다. 둘째, 여성군인에 대한 차별과 불공정한 제도 및 구성원 태도개선이 필요하며, 임용‧교육‧승진‧인사배치 및 생활여건 등에서 차별이 금지되어야 한다. 셋째, 3군 사관학교의 남녀통합모집으로 여성장교 비중을 늘려야 한다. 넷째, 국방부 및 각군 본부에 인권국(실)을 두어야 한다. 다섯째, 군사법원은 성인지적 형사절차를 기대하기 어려우므로 폐지해야 한다.

영문 초록

The purpose of this study was to diagnose the sexual assault case of the 20th Fighter Wing of the Air Force as national gender violence and to seek a desirable response direction from a gender perspective. Looking at the issues of sexual violence in the Air Force from this point of view, first, it lacked a gender-sensitive approach in the sexual assault case handling procedure, second, it revealed the typical form of national gender violence through poor investigation and organized concealment, and third, the collapse of the victim support system and professionalism. Fourth, it revealed the limitations of the military criminal justice system against gender violence. As a policy suggestion from a gender-sensitive perspective to solve this problem, first, military sexual violence cases should be regarded as gender sensitive based violence and a gender-sensitive criminal justice system should be applied. Second, discrimination against female soldiers and unfair systems and attitudes need to be improved, and discrimination in hiring, education, promotion, personnel assignment and living conditions should be prohibited. Third, the proportion of female military officers should be increased through the integrated recruitment of men and women at the 3 Military Academy. Fourth, a human rights bureau (office) should be established at the Ministry of National Defense and each military headquarters. Fifth, military courts that cannot expect sexist criminal proceedings should be abolished.
