헌법상 문화, 국가 그리고 기본권의 관계에 대한 고찰과 전망

국문 초록

문화라는 개념이 1980년 헌법에 실정법으로 수용된 지도 벌써 40년을 넘어서고 있다. 그동안 학자의 연구와 헌법재판소의 결정을 통해 문화국가의 구체적인 내용이 형성되어 왔다. 그러나 헌법학에서 과연 문화와 국가의 상관관계, 문화의 기본권과의 관계 등에 대한 치밀한 이론적인 연구가 있었는가에 대해서는 회의적이다. 문화국가 관련 연구가 있다고 하더라도 개별 문화 관련 쟁점에 관한 개별법률에 관한 해석과 정책연구가 주를 이루고 있는 것이 현실이고 문화와 국가 그리고 기본권의 상관관계를 본질에서 연구한 경우는 드물다. 현재의 한국 헌법학에서 문화국가론을 언급하는 것은 독일에서 논의된 문화국가 논쟁을 소개한 것을 그대로 별 이론 없이 받아들이는 정도가 아닌가 한다. 우리 헌법이 독일과 미국 헌법의 영향을 받아 일부 내용이 무비판적으로 계수된 측면도 없지 않다. 그러나 이제 우리나라의 헌법학에서 우리의 실정에 맞는 문화국가론에 대한 연구가 더 활발히 이루어져야 할 시기가 아닌가 한다. 기술적인 발전에 따라 지금까지 생각하지 못했던 새롭게 등장하는 기본권을 현재의 문화 상황에 맞게 헌법적으로 수용하는 것도 중요하지만, 그러한 새로운 기본권에 대한 본질적인 성찰 없이 과연 병렬적이고 나열적으로 헌법전에 수용하는 것은 자칫 헌법이라는 근본규범의 체계를 혼란하게 만드는 하나의 원인이 될 수 있다고 본다. 국가의 형성에 있어서 문화는 옐리네크가 국가구성의 3요소인 영역, 국민, 주권을 삼위일체로 묶어주는 결속력의 근본 원동력이 되지 않을까 한다. 문화를 국가의 정체성을 확립하는 요소와 원동력으로 파악하지 않고 자칫 문화의 산업적인 측면만을 강조하면서 문화의 헌법적인 의미를 희석하거나 더 나아가 상실하게 하는 것은 결과적으로는 국가의 정체성을 유지하고 발전시키는데 부정적 영향을 미칠 수 있다. 특히 헌법의 또 다른 기본원리인 평화국가원리에 입각한 남북한의 통일을 위해서는 문화의 헌법적 의미를 파악하는 것이 필요하다. 이를 위해서는 문화와 국가 그리고 우리 헌법의 최고가치인 인간의 존엄과 가치를 실현하는 기본권과의 상관관계를 좀 더 이론적으로 발전시키는 작업이 필요한 시점이다.

영문 초록

It has already been more than 40 years since the concept of culture was accepted as a positive law in the 1980 Constitution. Until now, specific contents of the cultural state have been formed through scholars research and decisions by the Constitutional Court. However, we are skeptical about whether there has been a detailed theoretical study on the correlation between culture and the state, and the relationship with the basic rights of culture in constitutional science. Even if there are studies related to cultural states, the reality is that interpretation and policy studies on individual laws on individual cultural issues are dominated, and the correlation between culture, state, and basic rights is rarely studied in nature. The current mention of cultural state theory in Korean constitutional studies seems to be to the extent that it accepts the introduction of the cultural state debate discussed in Germany without much theory. Some of the contents of our Constitution were uncritically counted under the influence of the German and US Constitution. However, it seems that it is time for more active research on the theory of cultural state suitable for our situation in Korea s constitutional science. It is also important to constitutionally accept emerging basic rights that have not been thought of so far according to the current cultural situation, but I think that accepting them in parallel and listed constitutional warfare without essential reflection can be one of the reasons for confusing the fundamental norms of the Constitution. In the formation of the state, culture may be the fundamental driving force of Yelinek s solidarity that binds the three elements of the state s composition: domain, people, and sovereignty into a trinity. Diluting or further losing the constitutional meaning of culture while emphasizing only the industrial aspects of culture without grasping culture as a factor and driving force to establish the national identity can consequently have a negative impact on maintaining and developing the national identity. In particular, it is necessary to grasp the constitutional meaning of culture for the unification of the two Koreas based on the principle of a peaceful state, another basic principle of the Constitution. To this end, it is time to develop a more theoretical correlation between culture and the state, and basic rights that realize human dignity and values, the highest values of our constitution.
