중립적 방조와 링크행위의 방조성

국문 초록

형법 제32조 제1항에서 규정하고 있는 타인의 범죄에 대한 ‘방조행위’는 일반적으로 ‘정범의 범죄행위를 가능·촉진·용이하게 하는 일체의 행위’로서 정의된다. 나아가 이러한 방조행위에는 유형적·물질적인 방조 뿐만 아니라, 정범에게 범행의 결의를 강화하도록 하는 등의 무형적·정신적 방조행위까지 가능하고, 작위 뿐만 아니라 부작위에 의한 방조도 포함함으로써 통상적으로 방조행위는 ‘무정형성’으로 이해되고 있다. 이러한 무정형성의 방조행위양태는 오늘날 비대면성을 특징으로 하는 인터넷을 이용한 행위들과 결합하여 보다 손쉽게 발생할 수 있다. 특히 오늘날 남녀노소 그리고 일상생활 및 직업활동 등에서 매우 활발하게 이용되고 있는 ‘인터넷링크(Internetlink)’가 불법정보 및 불법사이트를 안내하는 경우가 있다는 점에서 최근들어 대법원에서는 여러 차레 링크행위의 방조성 여부를 판단해왔다. 종전 판례(대판 2012도13748)는 불법저작물로 연결되는 링크행위에 대해 ‘개개 저작물 등의 웹 위치정보나 경로는 나타낸 것에 불과’하다고 하여 정범성 및 방조성 여부를 모두 부인하였다. 그러나 최근 대법원 전원합의체(대판 2017도19025)에서는 공중송신권침해게시물로 연결되는 링크행위에 대하여 그동안의 판례입장을 변경하여 방조책임을 인정하였는데, 다수의견(10인)과 반대의견(3인)의 치열한 공방전이 펼쳐졌다. 한편 이러한 전원합의체 다수의견에서는, 영리적·계속적인 링크행위 게시를 방조범성립의 주요 논거, 특히 정범범죄와의 인과관계를 인정하는 논거로 삼고 있는데, 이는 최근 독일을 중심으로 논의되고, 우리나라 다수의 논문에서도 조명되고 있는 ‘중립적 방조(neutrales Verhalten)’와 연결지을 수 있다. 일상적 행위(alltägliches Verhalten) 또는 직업적 행위(berufliches Verhalten)를 통한 방조행위의 경우 가벌적인 방조책임을 지울 수 있는지가 논의의 핵심이다. 본 논문에서는 링크행위의 법적 성격에 대한 입장을 변경한 최신판례를 살펴봄으로써 ‘중립적 방조’가 주는 시사점과 일상 및 직업적 행위의 방조성립 방향성을 재고해보고자 한다.

영문 초록

Today, living tangled in a complex society, and moreover, with non-face-to-face activities familiar in daily life and jobs through the routinely established Internet, my daily and professional behavior is more likely to be unexpectedly involved in someone s criminal behavior. In other words, it was not intended, but it was possible to think that it was by any chance to help someone commit a crime. Since this neutral act of assistance can be encountered by anyone in daily life and work, it is reasonable for legal reliability and legal stability to present more careful and detailed conditions to recognize this act as a punitive aid. The case of the target precedent has attracted attention in that it is an link act that can be easily performed by anyone of all ages, and the fierce battle between the majority and dissenting opinions is a prime example of the difficulty of establishing an aid. Both opinions presented various principles and standards for the establishment of aiding and abetting, respectively, and presented important legal arguments that should be considered in determining the establishment of aiding and abetting similar neutral acts in the future. The compatible values of freedom of action in the Internet environment and protection of copyrights are only relative values that can change with the times and situations rather than with either side having a superior position. At the present point of life, the dissenting opinion focused on freedom of action and the majority opinion on protection of copyright, but it is clear that the value of copyright protection is a very important basis for judgment in that someone s infringement of property rights cannot be justified. As the Dissenting Opinion points out, legal trust through precedents should be considered important in that many previous precedents have denied the aid of linking behavior, and infringement of property rights as well as personal rights can be increased.In order to prevent conflicts between freedom of (job) behavior and potential victims legal interests in the future, convincing criminal punishment should be made through clear standards of infringement of the boundaries, not criminal punishment.
