국문 초록

본 논문은 최근 해상테러‧해적의 위협과 국제사회의 대응노력을 분석하기 위한 것이다. 이를 위해 초국가적 위협 해적‧해상테러의 정의와 관련법규, 세계 해적사고의 발생동향, 주요 해역별 해적활동 동향, 국제사회의 대응노력을 살펴본 것이다. 21세기 해양시대에 해상에서의 불법행위, 특히 해적행위가 해상교통로의 안전과 발전을 위협하고 있다. 지난 십여 년 간 해상에서의 가장 큰 위협은 바로 해적이었다. 해적은 개념 및 활동과 관련해서 테러리즘과 직‧간접적으로 연계되어 있다. 탈냉전이후 강대국간 전쟁가능성은 현저하게 줄어들었지만 과학기술의 급속한 발전과 세계화의 과정에서 초국가적 위협인 해적의 피해사례가 전세계적인 이슈로 부각되고 있다. 소말리아를 제외한 서아프리카나 동남아시아 해역의 해적행위는 여전히 계속되고 있다. 해적문제는 국제물류를 담당하는 선박에 탑승한 승선원의 개인적안전은 물론 해상교통로의 안전을 위협하기 때문에 국제적인 대응이 시급한 사안인 것이다. 향후 ①해적관련 국제협약 이행, ②해적퇴치를 위한 지역협력, ③함정파견, 유엔활동, 근본해결 등을 위한 국제공조 등을 지속적으로 발전시켜 나가야 할 것이다.

영문 초록

This paper is intended to analyze the recent threats of maritime terrorism and pirates and the international community s response efforts. To this end, we looked at the definition of transnational threat piracy and maritime terrorism, related laws, trends in the occurrence of world pirate accidents, trends in piracy activities by major sea areas, and international efforts to respond. In the 21st century maritime era, illegal activities at sea, especially piracy, are threatening the safety and development of marine transportation routes. The greatest threat at sea over the last decade or so has been pirates. Pirates are directly or indirectly linked to terrorism in relation to concepts and activities. The possibility of war between the superpowers has significantly decreased since the post-Cold War, but piracy, a transnational threat, has emerged as a global issue in the course of rapid development and globalization of science and technology. Excluding Somalia, piracy in waters off West Africa and Southeast Asia still continues. The piracy problem is an urgent issue for international response as it threatens the personal safety of the crew aboard the vessel in charge of international logistics as well as the safety of sea transportation routes. In the future, the international community will have to continue to develop: (1) implementing international treaties on piracy; (2) regional cooperation in fighting piracy; (3) international cooperation in dispatching ships; UN activities; and fundamental solutions.
