국문 초록

우리나라는 여러 분야에서 세계 어느 나라보다도 빠르게 성장해왔다. 이러한 성장을 통해 다른 국가가 부러워하는 대한민국을 만들었지만 안전에 대한 부분은 1990년대 중반 성수대교붕괴와 삼풍백화점 붕괴 등 각종 재난사고가 발생된 이후 본격적으로 제도화되기 시작했다. 이러한 제도화로 다양한 입법이 이루어졌지만 이후에도 재난발생은 끊이지 않았고 대응은 미숙했다. 다행스러운 점은 재난예측과 대응기술이 계속 발전해왔다는 점이다. 재난에 대응할 수 있는 과학기술과 의학기술의 경우, 특히 최근 20년 동안 비약적으로 발전했다. 이러한 발전은 인류에게 재난을 감시하고 예측할 수 있는 다양한 도구와 방법을 제공해주고 있다. 관련분야는 지금도 시시각각 발전중이다. 그러나 이러한 발전에도 불구하고 상당수의 재난은 예고 없이 예측 없이 찾아온다. 결국 예고 없이 찾아오는 재난에 대해 효과적인 대응방안을 마련하는 것이 필요하다. 코로나19로 과거와 같이 사건 발생 후 입법으로 감염병과 같은 재난에 대응하는 것이 어렵다는 점이 들어났다. 이제는 미리 위험한 정보를 수집하고 이를 분석하여 적절한 대응책을 마련해야한다. 그리고 자연재난과 사회재난 등으로 분류된 재난을 위험등급으로 새롭게 개편해야한다. 중앙정부와 자치단체의 역할도 새롭게 만들어야한다. 또한 국가나 지방자치단체가 책임져야하는 최소한의 안전이 어디까지인지 결정해야한다. 그리고 어디까지 행정서비스를 제공할 것인지 사회적 합의가 필요하다. 그리고 그 최소한의 기준선을 「재난 및 안전관리 기본법」에 담아야한다. 이를 위해 적어도 위험분야에서 만큼은 포괄적 입법이 필요하다.

영문 초록

Korea has grown faster than any other country in the world in many fields. This growth made Korea enviable by other countries, but the safety aspect began to be institutionalized in earnest after various disasters such as the collapse of Seongsu Bridge and the collapse of Sampoong Department Store in the mid-1990s. Various legislations were enacted through this institutionalization, but disasters continued to occur even after that, and the response was immature. The good news is that disaster prediction and response technologies continue to advance. In the case of science and technology and medical technology that can respond to disasters, especially in the last 20 years, they have developed rapidly. These advances are providing mankind with a variety of tools and methods to monitor and predict disasters. The related field is still evolving every moment. However, despite these developments, a significant number of disasters come without warning. Ultimately, it is necessary to prepare effective countermeasures for disasters that come without notice. As in the past, it has been found that it is difficult to respond to disasters such as infectious diseases through legislation after the occurrence of an incident due to COVID-19. Now, it is necessary to prepare appropriate countermeasures by collecting dangerous information in advance and analyzing it. In addition, disasters classified as natural disasters and social disasters should be newly reorganized into risk grades. The role of the central government and local governments should also be renewed. In addition, it is necessary to determine the minimum level of safety that the state or local governments are responsible for. In addition, a social consensus is needed on how far administrative services will be provided. And the minimum baseline should be included in the「Basic Act on Disaster and Safety Management」. To this end, comprehensive legislation is needed, at least in the area of ​​risk.
