국문 초록

본 논문은 비전통 안보위협 증가와 관련하여 국방의 역할을 강화하기 위한 연구이다. 이를 위해 본 연구는 이론적 논의로서 비전통적 안보위협 개념과 국방의 역할 확대 방안을 검토하고, 이를 바탕으로 국방의 역할 강화를 위한 법령보완의 원칙과 소요를 제기한다. 비전통적 안보위협과 관련한 국가위기관리 현행 법령들을 보면 전·평시 개별법으로 분산 제정되어 연계성이 미흡하며, 전·평시 안보위기와 관련된 법령이 10여 종, 재해재난 분야와 관련한 법령이 60여 종이 있다. 이는 개별법령으로 제정되었고, 법이 추구하는 목적 또한 각기 달라서 위기대응 시 유기적 통합성을 발휘하기가 곤란하다. 주무기관과 지원기관 간의 지휘통제, 가용자원의 신속한 동원 및 지원, 유기적인 협조 면에서도 취약하다. 따라서 국가재난을 비롯한 국가위기상황 하에서 국방부의 적극적ㆍ선제적 지원을 위해 ①대응개념 및 절차통일, 대응조직간 연계성 유지, ② 전시 민방위 사태, 평시 재난사고, 테러상황에 통합대응 및 적용가능토록 국가위기관리기본지침과 연계하여 ｢통합방위법｣, ｢재난 및 안전기본법」, ｢감염병 예방 등에 관한 법」, ｢테러방지법｣, ｢국방재난관리훈령｣ 등의 제반 법령이 검토, 정비되어야 한다.

영문 초록

This article is intended to study the role of national defense in relation to the increase of non-traditional security threats. To this goal, this study reviews the concept of non-traditional threats and ways to expand the role of national defense as a theoretical discussion, and raises the principles and requirements to guarantee the role of national defense. According to the current laws on national crisis management related to non-traditional security threats, the linkage is insufficient because they are distributed into individual laws all the time. There are about 10 laws related to the security crisis, and 60 laws related to the disaster sector. This was enacted by individual laws, and the purposes pursued by the law are different, making it difficult to show organic unity in response to crises. It is also vulnerable in terms of command control between the competent agency and the support agency, prompt mobilization and support of available resources, and organic cooperation. Therefore, one-response concept and procedural unification for active and preemptive support from the Ministry of National Defense under the national crisis, including national disasters, Maintaining interagency connectivity, 2 Civil defense situation, Peacetime disaster, United Defense Act in connection with the National Crisis Management Framework Act, Framework Act on Disaster and Safety , The Infectious Disease Prevention Act, The Counterterrorism Act, Review of various laws and regulations such as the National Defense Disaster Management Order, It needs to be repaired.
