국문 초록

최근 대한민국 국회가 국민의 표현의 자유를 보장하기 위한다는 명목으로 국가보안법 제7조 관련 개정안을 입안하자 이에 대한 여론은 찬성과 반대로 나뉜 상황이다. 찬성 입장은 국가안보를 이유로 표현의 자유를 제한하는 것은 북한의 위협을 명분으로 국민을 억압할 수단으로 악용될 수 있음을 주장한다. 반대 입장은 국가안보는 확률로 접근해서는 안 된다고 보고 현재 대한민국의 전복을 노리는 세력이 존재하며, 민주주의를 반대하는 세력이 확산되면 극심한 사회혼란으로 이어져 국가의 안위까지 위태롭게 할 수 있음을 우려한다. 국가보안법 제7조의 개정은 시대적 요청이기도 하다. 그러나 헌법재판소는 동 조항은 위헌요소를 수정하였으므로 현재로서는 합헌적 기능을 수행한다고 보고 있다. 현재 학교교육에서부터 균형 잡힌 시민교육이 이루어지지 못하고 있다는 점, 이로 인해 국민이 민주주의 체제에 맞는 주권의식을 고르게 인식하지 못하는 상황이 존재한다는 점, 현재 정치적으로 선동과 기만에 의해 국민 여론이 양분될 수 있다는 점 등 현존하는 상황이다. 따라서 국가보안법의 폐기나 주요 조항의 개정을 위해서는 형법의 개정 등과 같은 사전 조치 등의 전제를 검토할 필요가 있다.

영문 초록

Recently, the National Assembly of the Republic of Korea drafted an amendment related to Article 7 of the National Security Act in the name of guaranteeing freedom of expression for the people. In this regard, public opinion is divided in favor and contrary. The positive position argues that if freedom of expression is restricted for national security, the basic rights of the people are suppressed under the cause of the North Korean threat. The opposite position argues that national security should not be approached with probability. Therefore, it is argued that the current forces aiming for the overthrow of the Republic of Korea exist, and the increase in opposition to democracy leads to extreme social confusion and threatens national security. The revision of Article 7 of the National Security Law is a request of the times. However, the current Constitutional Court considers this article to be constitutional because it has modified the unconstitutional elements. Currently, there is no balanced civic education from school education, there are people who do not understand democracy properly, and public opinion is divided politically due to false agitation. Therefore, it is necessary to review preliminary measures such as amendment of the criminal law for the abolition of the National Security Law or the revision of major provisions.
