국문 초록

오늘날 첨단과학기술의 발달로 인해 사이버공간에서의 수많은 공격과 위협 행위는 불특정 국가의 안보와 경제를 저해하는 심각한 위협으로 대두되고 있다. 특히 일반적인 사이버공격의 위험성 외에 포괄안보적 관점에서 항상 예측 불가능한 변수가 상존하고 있기 때문에 사이버공격에 대한 심층적인 안전장치와 법제가 필요하다. 주요 안보선진국가의 사이버안보 전략을 살펴보면, 독일은 정보의 종류와 목적, 정보처리 기간, 정보의 원산지 국가와 이전 대상 국가 등 국가별 법령과 기준에 대한 규율 및 개인정보보호조치를 종합적으로 평가하고 있으며, 사이버안보라는 공익과 기본권의 조화를 추구하는 적법한 법제를 갖추고 있다. 일본은 사이버위협과 사이버전략 자체를 외교안보정책과 연계하고 있으며, 나아가 국제협력을 강조하는 전략을 추구하고 있다. 영국은 사이버안보와 같이 국가적 법익수호를 위해 강력한 법제가 정비되어 있으며, 법집행기관의 수사권을 강화하고 수사 및 정보기관에게 정보통신에 관한 정보를 확보하도록 모든 권한을 부여하고 있는 점 등을 적극 감안하면 국내의 사이버안보 관련 법제정 시행에 시사하는 바가 크다.

영문 초록

Today, Numerous attacks and threats in cyberspace are emerging as serious threats that undermine the security and economy of an unspecified country because of the development of advanced science and technology. In particular, since there are always unpredictable variables from the perspective of comprehensive security in South Korea, in-depth safeguards and legislation against cyber attacks are necessary. The cybersecurity strategies of advanced countries, In Other Words, Germany comprehensively evaluates the type and purpose of information, the period of information processing, the laws and regulations of the country of origin, and personal information protection measures. In addition, it has a legitimate legal system that seeks to harmonize the public interest and basic rights of cybersecurity. Japan is linking cyber threats and cyber strategies with foreign and security policies, and is pursuing a strategy that emphasizes international cooperation. The UK has a strong legal system to protect national legal interests, such as cybersecurity, and is strengthening the investigative power of law enforcement agencies. In other words, all authorities are given to investigative and intelligence agencies to secure information and communication, and have great implications for the enforcement of domestic cybersecurity-related laws.
