비시가화지역 개발행위허가 및 성장관리방안에 관한 연구

국문 초록

전국토의 약 96%가 비시가화지역이다. 2003년 국토계획법이 시행됨에 따라 종전에는 도시지역에서만 개발행위허가를 하던 것을 비도시지역에서도 개발행위허가제도가 도입된 데 기인하여 비도시지역에 대한 개발행위허가가 급증하게 되었다. 그 동안 국토계획법에서 난개발방지를 위한 여러 제도의 도입에도 불구하고, 비시가화지역의 무분별한 개발행위를 방지하는 데 실패하였다. 이에 따라 소규모개발과 개별적인 건축에 의한 비계획적인 시가화의 확산을 막기 위해 개발압력이 높은 비시가화지역을 대상으로 체계적이고 계획적인 개발을 유도하고, 난개발 방지를 위한 성장관리방안 제도 도입을 위해 국토계획법을 제정하고 2014년 1월부터 시행하게 되었다. 하지만 많은 지자체에서는 기반시설 설치비용에 대한 부담을 이유로 성장관리방안을 수립하지 않겠다고 한다. 본 연구에서는 비시가화지역의 개발행위허가제도의 실태를 분석하고, 새로 도입된 성장관리방안 제도가 비시가화지역에서 난개발을 방지하는 적합한 제도인지 관련법 및 선행연구 등을 고찰해 효율적인 대안을 찾아보고자한다. 연구결과로 개발행위허가 여부를 판단할 객관적 기준 마련, 성장관리방안제도에 민간사업자의 참여를 유도하기 위해 최소한 지구단위계획 수준의 제도적 기반구축이 필요하다는 결론이다.

영문 초록

The territory of Korea is unurbanized nearly ninety six percent. After the enforcement of 2003 National Land Planning Act, the permission of development activity in the unurbanized areas were increased drastically. A few means of policy introduced by that Act were of almost of no use. So, the National Land Planning Act was revised in January 2014 for the purpose of growth management. The system aimed to prevent unplanned diffusion of urbanized areas through small-scale development and isolated construction, and to induce systematic and planned development in the unurbanized areas where the development pressure were high, and to prevent leap-frog development of cities. But many local governments are refusing to establish their growth management plan for the reason of infrastructure cost. This study analyzed the reality of the permission system of unurbanized areas. And tried to find out the effectiveness of new systems in preventing leap-frog development of unurbanized areas compared to old one. The results indicate that some institutional measures are needed. Firstly, an objective criteria should be established to judge whether the permission of development activity should be issued. Secondly, the basis to vitalize the participation of private sector at the level of district units plan should be arranged.
