국문 초록

부동산활동에 있어 가장 신중하게 다루어야 하는 부분 중의 하나가 부동산거래사고이며, 그 내용 또한 부동산의 기술적·경제적· 법률적 측면의 하자로 인한 복합개념으로 접근한다. 그러나 부동산권리분석활동은 부동산감정평가활동, 부동산중개활동, 부동산관리활동 등에서 부분적 간헐적으로 시행되고 있을 뿐만 아니라 권리분석의 거래사고를 사전에 방지할 수 있도록 하는 제도는 없다. 그리하여 본고에서는 위 부동산개발, 부동산중개, 부동산감정평가활동 등에서 수행되는 권리분석활동을 토대로 이들을 보완할 전문적 부동산권리분석활동의 필요성에 대하여 제시하였다. 그러나 다른 한편 부동산권리분석활동은 개인의 재산권보호와 부동산거래질서확립에 지대한 영향을 미치는 점을 고려하여 권리분석사의 자격요건과 책임을 제시하였다.

영문 초록

On real estate activities, one of the part that deal with most careful attention is a real estate incident of transaction, and should it’s contents also be accessible to the complex concept, that considered defects on technical, economic and legal aspects. However, not only intermittently been implemented activities of real estate title analysis in the real estate appraisal activities, real estate brokerage activities, property management activities, etc., but also any systems have been existed, that can be prevented real estate incidents of transaction in advance. Thus, this study suggests the need for activities of real estate title analysis, focused on the status of it’s activities in a real estate development, real estate brokerage, real estate appraisal in evaluation activities. And aims to establish the order of real estate transactions and guarantees personal property, by make systems to train professionals of real estate title analysis for the prevention of real estate incidents of transaction in advance. In conclusion, in this study I suggest the need for professional activities of real estate title analysis to complement the activities of it on current real estate development, real estate brokerage, real estate appraisal activities, etc. But on the other hand, carefully suggest qualification requirements and responsibilities of the real estate title examiner, considering the it’s profound impact on an individual s property rights and real estate transactions in order to establish.
