주택임대관리업 관련 법규 개선 방안에 관한 연구

국문 초록

주택임대관리업이 시작된 지도 3년 반, 「민간임대주택법」이 시행된 지도 1년 반이 지났다. 그리고 지금까지 관련 법규도 수차례 개정이 이루어져 왔다. 하지만 「민간임대주택법」이 주택임대관리업의 발전이라는 본연의 입법취지와 목적을 달성하기 위해 충분한 내용을 담고 있는지, 주택임대관리업의 발전을 위해서 법규상의 문제점과 개선방안은 없는지에 대한 충분한 연구와 검토는 지금까지 다소 미진한 것이 주지의 사실이다. 그리고 「민간임대주택법」 중 주택임대관리업 관련 규정에 대한 개선의 필요성에 대해서도 많은 의견이 제기되고 있다. 본 연구는 주택임대관리업 관련 법규 중 「민간임대주택법」을 중심으로 주택임대관리업의 발전을 위한 개선 방안에 대해 검토하였다. 세부적인 내용으로는 첫째, 주택임대관리업의 자기관리형 주택임대관리업과 위탁관리형 주택임대관리업의 이원화된 사업방식과 등록 기준에 대한 개선방안을 검토하였다. 둘째, 주택임대관리업의 주요 업무와 부수적인 업무에 대한 개선방안을 검토하였다. 셋째, 주택임대관리업 중 자가관리형 주택임대관리업체에 의무적으로 가입하게 되어있는 보증상품에 대한 개선방안을 검토하였다.

영문 초록

The Housing Lease Management Businesses (Hereinafter, HLMB ) has commenced 3 and half years ago, and the Special Act on Private Rental Housing(Hereinafter, PRH ) was enforced 1 and half year ago along with a number of its revisions. However, more studies on PRH are still considered to be in need because the current PRH is judged to be still insufficient to include enough contents to accomplish its own legislative intents and purposes, and to scrutinize whether PRH may have possible legal obstacles or may be further improved to promote developments of HLMB . In addition, there have been a number of opinions, which encourage more improvements on HLLB related regulations, especially the PRH . This study has reviewed on the improvement measures of laws and regulations, especially on the PRH to promote further developments of HLMB . In more details, First, this study has reviewed the characteristics of business difference between the self-management type and the consignment-type HLMB s, and also reviewed the improvement methods on registration criteria for both types. Second, it has reviewed the detailed improvement methods on major scopes as well as the additional scopes of HLMB . Lastly, it has reviewed the improvement methods on assurance goods, which has to be registered for the self-management type HLMB .
