국문 초록

「공동주택관리법」은 공동주택을 보다 투명하고 안전하며, 효율적으로 관리하여 국민들이 편리하고, 안정적인 주거생활을 영위하는 것을 목적으로 총 제11장, 제102조, 부칙 제35조로 구성되어 있다. 동법 중 제2장과 제6장은 입주자 간의 사법적 관리관계에 관한 것이고, 제5장은 행위허가, 제6장은 하자분쟁조정, 제7장과 제11장은 순수한 공법적 지도와 규제 및 지원에 관한 것을 내용으로 하고 있다. 「공동주택관리법」이 구「주택법」제5장을 답습하고 있으면서도 행정적 지원에 관한 규정을 보완한 점은 보다 발전적인 것이라 할 수 있다. 그러나 동법이 공동주택의 관리라는 사법적 자치영역에 속하는 사항을 구체적으로 규정하여 제한함으로써 사적자치의 침해는 물론이고, 사법의 법리와도 부합하지 못하고 있는 점이 문제점으로 지적되고 있다.본 논문은 「공동주택관리법」의 관리체계 중 특히 입주자의 자치관리에 관한 규정을 중심으로 그 관리주체, 대표기관, 의결기관, 집행기관의 구성과 문제점을 분석하고, 이에 따른 개선방안을 제시하는 데 연구의 목적을 두었다.

영문 초록

The purpose of Current Multi-Family Housing Management Act is to contribute to improving residential standards for the people by helping them manage multi-family housing transparently, safely, and efficiently, and it is made up of 11 chapters, 102 sections and 35 subsections Chapter 4 and 5 of this Act provide for judicial management relations between occupant , and Chapter 5(permission to engage in activities), Chapter 6(mediation of disputes about defects), Chapter 7 and Chapter 11 are provisions about pure public legal regulation and support. While Multi-Family Housing Management Act is following Chapter 5 of “(old) Housing Act”, it could be more developmental because it has supplements provisions on administrative support. However, this Act could be criticized not only infringed the private autonomy, it does not even meet the legal principle of justice, because this Act specifically restricts concept of Multi-Family Housing management, belonging to the jurisdictional autonomous area. This paper analyzes the problems of the management system of Multi-Family Housing Management Act , especially around the regulations about the autonomous management of occupant , on organization of it’s management entity , representative, decision-making and executive bodies, furthermore, suggests improvement.
