국문 초록

이 논문의 제목은 공동주택 공용부분의 하자와 관련한 민사책임이라고 정하였다. 다양한 논의과정을 거쳐서 일정한 법제도가 만들진 이후에 예상하지 못하였던 다양한 법적 문제들이 어느 정도 발생할 것인지를 정확하게 예단한다는 것은 사실상 용이하지 않다고 보아야 한다. 그러함에도 불구하고 당해 법제도의 시행으로 인하여 장래에 지속적으로 불합리한 결과가 발생할 가능성이 있다면 그러한 결과의 발생을 최소화할 수 있는 다양한 방안들이 꾸준하게 모색되어야 할 것이다. 이와 관련하여 구분소유제도는 새롭게 창출된 제도라는 점에서 종래에 발생한 법리적 또는 관련규정상의 문제점들을 면밀하게 파악한다면, 장래에 정립될 구분소유제도는 조금 더 합리적이고 실질적 정의에 합치될 가능성이 높을 것으로 생각한다. 이와 관련하여 현재 우리나라의 주거유형은 대부분 아파트의 형태이고 수도권 등의 대도시의 경우에는 대략 70%를 차지하고 있는 것으로 알려지고 있다. 특히 아파트의 경우에는 주거공간 내지 생활공간으로서의 기능뿐만 아니라 거래가 빈번한 중요한 재산권의 객체로서 인식되고 있지만, 1동의 건물에 다수의 구분소유자들이 필연적으로 거주하여 생활하고 있다는 점에서 전유부분 및 공용부분에 대한 하자의 보수 및 하자보수에 갈음한 손해배상의 문제와 관련한 다양한 법적 문제 등이 발생하고 있다. 본고에서는 공동주택 공용부분의 하자와 관련한 주요한 내용을 검토하면서, 특히 공동주택 공용부분의 하자 및 안정성 흠결로 인하여 발생할 수 있는 문제점과 그 개선방향에 대하여 몇 가지 법적 쟁점을 중심으로 검토하였다.

영문 초록

영문초록The title of this thesis is “Civil Liability in connection with the Defect of the Common Sector in Apartment Houses”. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Since the divided ownership system is something that is being newly developed, a thorough examination of past problems can lead to a future s adhesion contract system that is more rational and accords with substantial justice. Over the majority of dwelling pattern in Korea today are apartment houses, namely a shape of apartment, and its percentage of the capital area is approaching 70%. Beyond its simple meaning as residental space, this apartment house is directly connected to the property rights of the people, and since many families live as divided in one building, Defects Liability-interrogation on repair of defects and compensation for damages-has come to the fore as a socially significant problem in case of occurrence of defects of an apartment house. I explained about the main contents of the Defect of the Common Sector in Apartment Houses and dealt with the important contents of the Defect of the Common Sector and Security in Apartment Houses and suggested especially the problems and improvements in connection with the Defect of the Common Sector and Security in Apartment Houses.
